64 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN <br />AGREEMENT WITH THE SEABOARD COAST LINE RAILROAD COMPANY CON- <br />CERNING THE INSTALLATION AND MAINTENANCE OF A COPPER PIPE <br />UNDER THE PROPERTY OF THE RAILROAD COMPANY AT OR NEAR ALGREN, <br />VIRGINIA. <br /> <br /> WHEREAS, the Portsmouth Department of Public U~ilities <br />has made application to the SeabOard Coast Line Railroad Company <br />for permission to install a 3/4 inch copper water line under <br />the property of the railroad near Algren, Virginia; and <br /> WHEREAS, the Seaboard Coast Line Railroad Company <br />requires a written agreement between the railroad and the City <br />of Portsmouth before allowing any such installation of pipes <br />under its property; and <br /> <br /> WHEREAS, the Seaboard Coast Line Railroad requires a <br />resolution of the City Council authorizing its City Manager <br />to enter into a written agreement. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br /> the City of Portsmouth, Virginia, in a ~egular meeting assembled <br /> that the City Manager of said City be, and he hereby is, authorized <br /> to enter into an agreement with the Seaboard Coast Line Railroad <br /> Company, and to sign same on behalf of said City whereby said <br /> Railroad Company grants unto said City the right or license <br /> to install and maintain, for the purpOse of conducting water, <br /> a line of 3/4 inch copper pipe across the right of way and <br /> under the main track of said Railroad Company at or near <br /> Chesapeake (Atgren), Virginia, as more particularly described <br /> in said agreement, which agreement is dated June 1, 1973, <br /> a copy of which agreement is filed with this City Council. <br /> Adopted by the Council of the City of Portsmouth, <br /> Virginia, at a meeting held July 24, 1973. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
