A RESOLUTION TO PROVIDE FOR THE ACQUISITION OF CERTAIN PROPERTY <br />BY THE CITY OF PORTSMOUTH, VIRGINIA, UNDER EMINENT DOMAIN PRO- <br />CEEDINGS PURSUANT TO CHAPTER 471 OF THE ACTS OF ASSEMBLY, AS <br />AMENDED, SAID PROPERTY BEING NECESSARY FOR THE CONSTRUCTION, <br />ALTERATION AND WIDENING OF WOOL AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth has found it necessary <br />to acquire the interest hereinafter specified in and to the <br /> erelnarter described parcel of land situate in the City of <br />Portsmouth, Virginia, for the purpose of constructing, altering <br />and widening Wool Avenue. <br /> <br /> WHEREAS, the City of Portsmouth has not been able to <br />purchase the property described herein, necessary to the pro- <br />ject, because of a defect in the title to the property in that <br />the present record owners cannot be lo~ated. <br /> <br /> WHEREAS, advancement of the ~ork and use of said pro- <br />~ect will be delayed unreasonably if said property is not made <br />available as Soon as possible. <br /> <br /> NOW, TIIEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> 1. The City Attorney is directed to institute eminent <br />domain proceedings against the following property situate in the <br />City of Portsmouth, for the purpose of acquiring fee simple title <br />therein, together with any and all easements 'of a.ccess, light or <br />air incident to the lands of the landowner abutting upon said <br />property, in accordance and pursuant to Sections 2.06, 2.07 and <br />2.08 of th~ Charter of th~ City of Portsmouth (Chapter 471 of <br />the Acts of Assembly of 1970, as amended), and to deposit to <br />the credit of the Clerk of the Circuit Court of the City of <br />Portsmouth as provided by !aw the sum hereinafter specified to <br />compensate the owners of the parcel of land known, numbermd and <br />designated as Parcel IS as shown on that certain plat entitled <br />"Property To Be Conveyed To City Of Portsmouth For Mt. Herman <br />Conservation And Development Project VAR-69," dated July 25, <br />19~S, made by Baldwin & Geegg, Ltd., reference to said plat <br />being made for a more particular description of the property. <br /> <br /> Name of the property owner Ethel Richardson and Eddie <br />Nixon and amount to be paid $54.00. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia, at a meeting held September 9, 1975. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
