91 A RESOLUTION GRANTING A USE PE~4IT TO OPERATE A GASOLINE SERVICE STATION ON CERTAIN PROPERTY SITUATE NEAR THE INTERSECTION OF HODGES FERRY ROAD AND PORTSMOUTH BOULEVARD. WHEREAS, Southland Corporation has made an application pursuant to Section 40-70(b) of the Code of the City of Ports- mouth, Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS, the applicant and the Planning D~rector have done all things required to be done in connection with said applicatzo n and the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (a) That the use for which the permit hereinafter described is sought: (1) Will not adversely effect the health or safety of persons residing or working in the neighbor- hood of the proposed use; (2) Will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood; and (3) Will be in accord with the purposes of the Zoning Chapter of the City Code. (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40-70(b) of the City Code to operate a gasoline service station on the property described as follows: Beginning at the southeast corner of Hodges Ferry Road and Portsmouth Boulevard; thence southerly along the east side of Hodg~s Ferry Road approximately 113' to a side property line; %hence easterly along said line approximately 184' to a point; thence northerly approximately 110' to the south right-of-way line of Portsmouth Boulevard; thence westerly along said right-of- way approximately 159' to Hodges Ferry Road, the point of origin. (c) The granting of this use permit ms subject to the following condition: That petitioner shall construct all improvements per site plan prior to his petition for a use permit.
