9O A RESOLUTION GRANTING A USE PEr,lIT TO OPERATE A HOME FOR THE AGED ON PROPERTY SITUATE NEAR THE INTERSECTION OF FIFTH STREET AND PORTSMOUTH BOULEVARD. WHEREAS, Carl Pearson has made an application pur- suant to Section 40-78[b) of the Code of the City of Ports- mouth; Virginia, 1973, for the granting of a use permit as hereinafter described; and WHEREAS~ the applicant and the Planning Director have done all things required to be done in connection with said application and the Planning Commission has recommended the granting of said use permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: (a) That the use for which the use permit herein- after described is sought: (1) Will not adversely effect the health or safety of persons residing or working in the neighborhood of the proposed use; (2) Will not be detrimental to the public welfare or injurious to property or improve- ments in the neighborhood; and, (3) Will be in acccrd with the purposes of the Zoning Chapter of the City Code. (b) The City of Portsmouth is hereby granting a use permit pursuant to Section 40-78Ib) of the City Code to operate a home for the aged on the property described as follows: Beginning at the northeast corner of Fifth Street and Portsmouth Boulevard; thence east along Portsmouth Boulevard approximately 150' to a side lot line; thence north approxi- mately 125' to a point; thence west approxi- mately 150' to the east right-of-way line of Fifth Street; thence south along said right- of-way approximately 125' to Portsmouth Boul- evard, 5o the point of origin. ~ , (c) The granting of this use permit is subject to the following condition: Complying with all requirements and receiving all pe_~mits from the State and City. Adopted by the Council of the City of Portsmouth, Virginza, at a meeting held October 26, 1976. Teste:
