A RESOLUTION AMENDING RESOLUTION NO. 1976-74 ADOPTED ON AUGUST <br />24, 1976 PERTAINING TO THE SETTING FORTH THE CITY OF PORTS- <br />MOUTH'S HIGHEST HIGHWAY PRIORITY PROJECT FOR STATE/CITY PART- <br />ICIPATION ~ND CO~ItTTING THE CITY TO PAY ITS FIFTEEN PERCENT <br />SHARE OF THE COST OF SUCH PROJECTS; THE A~MENDMENT REQUIRES THE <br />CITY TO PAY THE DEPARTMENT OF HIGHWAYS A~D TRANSPORTATION OF <br />THE COMMONWEALTH OF VIRGINIA ONE HUNDRED PERCENT OF THE COST <br />INCURRED FOR ANY PROJECT WHICH THE CITY DECIDES NOT TO PROCEED <br />WITH. <br /> <br /> WHEREAS, on August 24, 1976, this Council adopted a <br />resolution setting forth the City of Portsmouth's highest high- <br />way priority pro~ects for state/city participation and committed <br />the City to pay Fifteen (15) percent share of the cost of such <br />projects; and <br /> WHEREAS, the State has requested an amendment to such <br />resolution to provide that the City commit to pay One hundred <br />(100) percent of the cost incurred by the Department of Highways <br />and Transportation if the City decides not to proceed further <br />with said project. <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br /> City of POrtsmouth, Virginia that Resolution No. 1976-74 is <br /> amended by adding the following: <br /> <br /> "The City further agrees that if the said <br /> project is established as herein requested; <br /> and, thereafter, the said City decides not <br /> to proceed further with the said project, <br /> then the City, by this Resolution, agrees <br /> to repay the Department of Highways And <br /> Transportation of the Commonwealth of Vir- <br /> ginia for One hundred (100) percent of the <br /> cost incurred for the said project to the <br /> time of abandonment. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br /> Virginia, at a meeting held October 12, 1976. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
