A RESOLUTION TO PROVIDE FOR~ THE~.~JISITIC~N OF C~L~EAIN PROP~ERT~,BY ~ 'CI~f OF PORTSMOUTH, VIRGINIA, UNDER ~4INENT DC~AIN PRC~,:~]INGS PURSUANT TO CHA~I~L~ 471 OF THE ACTS OF ASSE~SLY, AS A~5~DED, SAID PROPERI~f BEING NECESSARY FOR THE CONSTRUCTION, AL'±~ATION A~ND ~IAINTENANCE OF THE CRADOCK STREET I~PROV~4E~f PROJECT. WHEREAS, the City of Portsmouth has found it necessary to acquire interests hereinafter specified in and to the hereinafter described parcel of land sibaate in the City of Portsmouth, Virginia, for the purpose of constm~/cting, altering and maintaining the Cradock Street Improvement Project. WHEREAS, the City of Ports~aouth has not been able to purchase property described herein, necessary to the project, because the owners thereof in the City have not been able to agree upon a price to be paid therefor; and I~zK~AS, advancement of the work and use of the said project will be delayed unreasonably if said property is not made available as soon as possible. NOW, ~4EREFORE, BE IT RESOLVED by the Council of the City of Ports- mouth, Virginia: 1. The City Attorney is directed to institute eminent dc~u~in proceedings against ~he following property situated in the City of Portsmouth, for the purpose of acquiring fee simple title therein, tOgether with any and all easements of access, light or air incident to the lands of tb~ landowner abutting upon said property, in accordance and pursuant to Sections 2.06, 2.07 and 2.08 of the Charter of the City of Portsmouth (Chapter 471 of the Acts of Assembly of 1970, ~as amended), and to deposit to t~e c~£edit of the Clerk of the Circuit Court of the City of Portsmouth as provided by' law the sum hereinafter stated to cc~pensate to the owners of the parcel of land demignated ~n the plat entitled, "Plat Showing Drainage Easement To Be Conveyed To City Of Portsmouth By Nancy C. Kennedy", a copy of said plat is attached hereto. 2. The n~ae of the property owner is: NanCy C. Kennedy. The amount to be paid is: $2500.00.
