69 <br /> <br />A RESOLUTION REQUESTING THE VIRGINIA DEPARTMENT OF HIGHWAYS <br />AND TRANSPORTATION TO SUPPORT THE DESIGN AND RECONSTRUCTION <br />OF POPLAR HILL ROAD AND TOWNE POINT ROAD BETWEEN ROUTE 17 AND <br />TWIN PINES ROAD; CITY TO PAY TEN PERCENT OF THE TOTAL COST. <br /> <br /> WHEREAS, Section 33.1-89 of the Code of Virginia as <br />amended by the 1970 session of the General Assembly, authorizes <br />the State Highway and Transportation Commissioner to acquire <br />rights-of-way for construction, reconstruction, alteration, <br />maintenance and repair of public highways within the boundary <br />of municipalities on projects which are constructed with <br />State or Federal participation; and <br /> <br /> WHEREASr Section 33.1-89, as amended, further provides <br />that the Virginia Department of Highways and Transportation <br />may exercise its authority only upon receipt of an official <br />request from the City involved; and <br /> <br /> WHEREAS, this Resolution is contingent upon a satis- <br />factory drainage plan to the City of Portsmouth being devised. <br /> <br /> NOW, THEREFORE~ BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the Council hereby requests <br />the Virginia Department of Highways and Transportation to <br />support the design and reconstruction of Poplar Hill Road <br />and Towne Point Road between Route 17 and Twin Pines Road <br />located within the corporate limits of the City of Portsmouth. <br /> <br /> BE IT FURTHER RESOLVED that the City of Portsmouth agrees <br />to pay ten percent (10%) of all costs incurred in the design <br />and reconstruction of Poplar Hall Road and Twin Pines Road. <br /> <br /> BE IT FURTHER RESOLVED that it is understood that such <br />design and reconstruction be handled by the Virginia Department <br />of Highways and Transportation under established policies and <br />procedures and the decision of &he Commissioner of same in all <br />instances will be final. <br /> <br /> BE IT FURTHER RESOLVED that the City Clerk is directed <br />to forward a copy of this Resolution to the Virginia Depart- <br />ment of Highways and Transportations. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held September 26, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
