A RESOLUTION AUTHORIZING THE CONSTRUCTION OF A SIDEWALK IN <br />THE 3400 BLOCK OF DOWNES AVENUE ABUTTING 3445, 3449 DOWNES <br />AVENUE AND THE WEST SIDE OF 3401 TREXLER AVENUE, WHERE <br />STANDARD SIDEWALKS DO NOT EXIST THE ABUTTING LANDOWNERS <br />SHALL BE ASSESSED AT THE COST OF $3.00 PER FRONT LINEAL <br />FOOT; AND DIRECTING THAT AN ABSTRACT OF THIS RESOLUTION <br />BE RECORDED WITH A STATEMENT SHOWING THE ESTI~IATED AM~OUNT <br />THAT WILL BE ASSESSED SUCH LANDOWNERS. <br /> <br /> WHEREAS,-~y petition submitted in accordance with law, <br />certain abutting landowners have petitioned the City of <br />Portsmouth to construct a sidewalk in the 3400 block of <br />Do%~nes Avenue abutting 3445,-3449 Downes Avenue and ~the <br />west side of 3401 Trexler Avenue, where standard side~valks <br />do not now exist; the abutting landowners shall be assess- <br />ed paying $3.00 per front lineal foot of the cost of said <br />sidewalk; and <br /> <br /> WHEREAS, notice has beeh duly given to the abutting <br />landowners, as provided by law, that a hearing would be <br />held before the Council of the City of Portsmouth on July <br />25~ 1978, at 7:30 P.M., in the Council Chambers; and <br /> <br /> WHEREAS, said hearing has been duly held and in the <br />judgment of the Council the said sidewalk should be con- <br />structed. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia: <br /> <br /> t. That the construction of a sidewalk in the 3400 <br />block of Downes Avenue abutting 3445, 3449 Dowries Avenue <br />and the west side of 3401 Trexler Avenue~ where standard <br />sidewalks do not now exist, is hereby authorized. <br /> <br /> 2. That the abutting landowners shall be assessed at <br />a ra~e of $3.00 per front lineal foot pursuant to a peti- <br />tion signed by seventy-five (75%) percent of the property <br />owners affected by the requested improvements. <br /> <br /> 3. That the City Clerk forthwith cause to be recorded <br />an abstract of this resolution, together with a statement <br />showing the ownership and location of the property to be <br />affected by the proposed sidewalk and the estimated a~ount <br />that will be assessed against each abutting lando~ner in ac- <br />cordance with a statement thereof on file in his office. <br /> <br /> Adopted by the Council of the City of Portsmouth, vir- <br />ginia, at a meeting'held July 25, 1978. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
