93 <br /> <br />A RESOLUTION ACCEPTING THE PROPOSAL OF THE DEPARTMENT OF <br />HIGHWAYS AND TRANSPORTATION OF THE COMMONWEALTH OF VIRGINIA <br />RELATING TO CONSTRUCTION OF THE SECOND DOWNTOWN TUNNEL AND <br />AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH DOCUMENTS AS <br />MAY BE NECESSARY TO COMPLETE THIS TRANSACTION. <br /> <br /> WHEREAS, the Department of Highways and Transportation <br />of the Commonwealth of Virginia desires to acquire right-of- <br />way and permanent and temporary easements needed for the <br />construction of the second downtown tunnel; and <br /> <br /> WHEREAS, the Department of Highways and Transportation <br />of the Commonwealth of Virginia has appraised the value of <br />the right-of-way needed and the permanent and temporary <br />easements required for said construction as Four Hundred <br />Thirty-eight Thousand, Nine Hundred Thirty-six Dollars <br />($438,936~); and <br /> WHEREAS, the construction of said downtown tunnel is of <br /> such importance to the City of Portsmouth that the con- <br /> veyance of such right-of-way and permanent and temporary <br /> easements supersede the need of the City for said property <br /> and such is hereby declared to be excess; and <br /> <br /> WHEREAS, the Department of Highways and Transportation <br /> is an agency of the Commonwealth of Virginia; and <br /> WHEREAS, Section 2.09(b~ of the Charter of the City of <br /> Portsmouth provides that the City may sell or convey property <br /> to the Commonwealth of Virginia, any political subdivision <br /> thereof, or to the Federal Government without advertisement <br /> and without receiving bids therefor. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br /> City of Portsmouth, Virginia that the proposal of the Depart- <br /> ment of Highways and Transportation of the Commonwealth of <br /> Virginia to acquire the right-of-way and permanent and temporary <br /> easements as hereinafter-described for the sum of Four <br /> Hundred Thirty-eight Thousand, Nine Hundred Thirty-six <br /> Dollars ($438,936.) be, and the same hereby is, accepted. <br /> <br />Parcel 001 Being as shown on Sheet 6 of the <br />plans for Route 264, State Highway Pro~ect 0264- <br />124-105, RW-201, and lying on the north (left) <br />side of 1-264 westbound land certerline and <br />adjacent to the existing north right of way and <br />limited access line of present Route 264 from <br />the lands of Graydon P. McGinley opposite approxi- <br />mate Station 0+53 to the south existing right <br />of way line of present Green Street opposite <br />approximate Station 0+79 and containing 0.O03 <br />acres, more or less, land; and being all of the <br />same land acquired by the landowner from Sub- <br /> <br /> <br />
