7O A RESOLUTION GRANTING A USE PERM~IT TO TIDEWATER BIBLEWAY TEMPLE TO OPERATE A CHURCH OR HOUSE OF WORSHIP AT 504-510 HIGH STREET. ~%~EREAS, Tidewater Bibleway Temple, pursuant to Section 40-120(a) and 40-72g0) of the Code of the City of Portsmouth, Virginia, 1973, has petitioned for the granting of a use permit as hereinafter-described; and I~EREAS, the applicant and the Plann£n~ Director have done all things required to be done in connection with said application; and I~EREAS, the Planning COmmission has recommended the granting of said use per~±t. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouthr Virginia: 1. That the use for which the permit is sought for the o~eration of a church or house of worship: ~a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) W~i1 not be detrimental to the public use or in~urious to property or i~provements in t~-e neighborhood; and lc) Will be in accord with the purposes of the Zoning Chapter of the C~ty Code. 2. Tidewater Bibleway Temple is hereby granted a ~se permit pursuant to S'e~t~on 40-120(~) and Section 40-72 ~[b) of the Code of the 'C~ty of Portsmouth, Virginia, to operate a church or house of worship on the property described as follows and known as 504~410 High Street: Beginning at a point on the north side of High Street, said-ooint being 30 feet west from the northwest intersection of High Street and Dinwiddie Street; thence north 65 feet, more or less; thence west 40 feet, more or less; thence north 55 feet, more or less; thence west 35 feet, more or less; thence south 113 feet, more or less to the north right of way of High Street; thence east along said right of way of High Street 75 feet, more or less, to the Point of Beginning, "said property formerly befng known as the State Theatre.
