69 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO RELEASE EASEMENTS <br />RESERVED FOR PUBLIC UTILITIES IN THE MOUNT HERMON AREA. <br /> <br /> WHEREAS, by Ordinance No. 1977-140 adopted by the Council <br />of the City of Portsmouth, Virginia, on October 11, 1977, a <br />portion of Kirn. Avenue lying between High Street and County <br />Street was closed; and <br /> <br /> WHEREAS, by Ordinance No. 1978-34 adopted by the Council <br />of the City of Portsmouth, Virginia, on March 14, 1978, portions <br />'of Cutheriell, McKinley, Whitson, County and Hickory Streets <br />were closed; and <br /> <br /> WHEREAS, by the terms of said Ordinances the City of <br />Portsmouth retained an eaSement in said former streets for <br />the purpose of operating and maintaining public utilities; and <br /> WHEREAS, said public utilities have been relocated in <br /> connection w±th the development of th~ Mount Hermon Redevelop- <br /> ment and Conservation Project; and <br /> <br /> WHEREAS, the City no longer has a requirement for said <br /> utility easements and the same are hereby declared to be <br /> surplus. <br /> <br /> NOW, THEREFOREr BE IT RESOLVED by the Colkncil of the <br /> City-of Portsmouth, Virginia, that the City Manager be, and <br /> he hereby is, authorized to release said public utility ease- <br /> ments in %hat portion of Klrn A~enue closed by Ordinance No. <br /> 1977-140 and Cutheriell, McKinley, Whitson, County and Hickory <br /> Streets closed by Ordinance No. 1978-34. <br /> <br /> BE IT FURTHER RESOLVED that the City M~nager he, and he <br /> here hereby is, authorized %o execute such deed of release <br /> as may be necessary tO accomplish the purpose of this <br /> Resolution. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br /> at a meeting held September 8, 1988. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
