68 A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1973, AS AMENDED, SAID PROJECT BEING KNOWN AS "CYPRESS COVE VILLAS, PHASE IV" AND DESIGNATED AS GHP-81~3. WHEREAS, Portsmouth Enterprises, Inc. has made application pursuant to Section 4'O~55 'of the Code of the city of Portsmouth, Virginia, 1973, as 'amended, for the granting and approval of a group housing project known as "Cypress Cove Villas, Phase IV". WHEREAS, the application has been determined by the Planning Commission to have me~equirements~of' Section 40~55, Code of the City of Portsmouth;' Vi~ginia,"19~3, as amended; and WHERE~S, the Planning commission has reviewed such appli- cation and site plans submitted therewith' and has recommended approval of said application; and W/TEREAS, t'he developer has been informed that approval of the group housing project pursuant to said Section 40-55 grants only an exemption from certain requirements for residences as stated in said Section and does not constitute a waiver of any other requirements embodied'in the Subdivision Ordinance, Zoning Ordinance, the Code 'of the City of Portsmouth or any other applicable State or Federal'taws or regulations; ~d WHEREAS, the developer is aware that building permits and/or any-other required permit will be issued only upon com- pliance..with the ordinances, laws, or regulations applicable thereto. NOW, THEREFORE, BE-ET RESOLVED by the Council of the City of Portamouth,'Virginia, that--the certain group housing project known as "CypreSs Cove Villas, Pkase IV" and designated as GHP- 81-3, and more specifically shown on plans prepared by Dan E. Griffin, A.I.A., filed with the appropriate officials of the City of Portsmouth and made a part hereof, is hereby granted approval.
