5O <br /> <br />A RESOLUTION GRANTING A USE PERMIT TO EARL J. COOK, SR. TO <br />OPERATE A JUNKYARD AT 703-705 JAMESTOWN AVENUE. <br /> <br /> WHEREAS, Earl J. Cook, Sr., has made application pursuant <br />to Section 40-69(b) of the Code of the City of. Portsmouth, <br />Virginia, 1973, for the granting of a use permit as hereinafter- <br />described; and <br /> <br /> W~_qEREAS, the applicant and the Planning Directo~ have <br />done all things required to be done in connection with said <br />application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia: <br /> <br /> 1. That the use for which the use permit hareinafter- <br />described is sought: ~ <br /> <br />of persons <br />posed use; <br /> <br />(a) Will not adversely affect the health and safety <br />residing or working in the neighborhood of. the pro- <br /> <br /> (b) <br />injurious to <br />and <br /> <br /> Will not be detrimental to the public use or <br />the property or improvements of the neighborhood; <br /> <br /> (c) Will be in accordance with the purposes of the <br />Zoning Chapter of the City Code. <br /> <br /> 2. Earl J. Cook, Sr., is hereby granted a use permit <br />pursuant to Section 40-69(b) of the Code of the City of Ports-. <br />mouth to operate a junkyard at the property described-as <br />follows: <br /> <br />UP-82-12 <br /> <br /> Beginning on the east side of Jamestown <br />Avenue 120 feet, more or less, south from its <br />intersection with County Street; thence east <br />a!ong the south line of an alley 117 feet, <br />more or l~ss; thence south 78.?5 feet; thence <br />west 117 feet, more or less, to the east.right- <br />of-way of Jamestown Avenue; thence north along <br />the said right-of-way of Jamestown Avenue 78.25 <br />feet to the point of origin. <br /> <br /> <br />
