45 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A_N <br />AGREEN~NT WITH SEABOARD SYSTEM RAILROAd, INC. FOR INSTALLATION <br />OF A PUBLIC UTILITY SEWAGE LINE ACROSS THE RIGHT-OF-WAY AN~ <br />UNDER THE ~IN TRACK OF THE RAILROAD AT LAIGH ROAD. <br /> <br /> ?~EREAS, the City has awarded a contract to Asphalt <br />Roads And Materials, Inc. for construction of certain public <br />utilities including sewage lines in connection with the <br />Hattonsville Redevelopment Project; and <br /> <br /> WHEREAS, a portion of said 8" cast iron sewage pipe is <br />to be constructed across the right-of-way and under the main <br />track of the Seaboard System Railroad, Inc. at Laigh Road; and <br /> <br /> WHEREAS, Seaboard System Railroad, Inc. has requested that <br />the City enter into a license agreement for the location and <br />installation of said sewage line across the right-of-way and <br />under the main track of the railroad. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by. the Council of the City <br />of Portsmouth, Virginia, that the City Manager be, and he hereby <br />is, authorized to enter into a license agreement with Seaboard <br />System Railroad, Inc. for the purpose of granting unto the City <br />the right to install and maintain a sewage line of 8" cast iron <br />pipe across the right-of-way and under the main track of the <br />railroad at Laigh Road. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held June 28, 1983. <br /> <br />Testeo. <br /> <br />City Clerk <br /> <br /> <br />
