37 <br /> <br />A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF T~E CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS ~ENDED, SAID PROPERTY~ BEING KNOT;~ AS <br />VICTORIAN SQ~ARE_~AND DESIGNATED AS GH~-83-2. .... <br /> <br /> WHEREAS, Castle Development Corporation, for Victorian <br />Square Associates, has made application pursuant to Section <br />40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended, for the granting and approval of a Group Housing <br />Project known as Victorian Square at 401 and 403 Maryland <br />Avenue; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of Section <br />40-55 of the Code of the City of Portsmouth, Virginia, 1973, <br />as amended; and <br /> <br /> ~%~EREAS, the Planning Commission has reviewed such appli- <br />cation and site plans submitted therewith and has recommended <br />approval of said application; and <br /> <br /> WHEREAS, the developer has been informed that aDoroval <br />~of the Group Housing Project pursuant to said Section-40-55 <br />grants only an exemption from certain requirements for residences <br />as stated in said section and does not constitute a waiver of <br />any other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, the Code of the City of Portsmouth, or any <br />other applicable local, state or federal laws or regulations; <br />and ~ <br /> <br /> WHEREAS, the developers are aware that building permits <br />or.any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia that the certain Group Housin~ Project <br />known as Victorian Square and designated as GHP-83-2 and more <br />specifi~ally shown on plans prepared by Castle Developers con- <br />sisting of a site plan, exterior elevation plan and floor plan <br />and filed with the appropriate officials of-the City of Ports- <br />mouth, Virginia and made a part hereof, is hereby grante~ ap- <br />proval subject to an amendment to the floor Dian in order that <br />the minimum required floor area for each dwelling unit, ex- <br />clusive of garages and patios, be six hundred (600) s~uare feet. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held May 24, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
