36 <br /> <br />A RESOLUTION GRA!~TING~APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CiTY OF PORTSMOUTH, <br />VIRGINIA, ~973, AS AMENDED, SAID PROJECT BEING KNO~ AS OLDE <br />TO~NE CONDOMINIU~4S AND DESIGNATED AS GHP-83-3. <br /> <br /> WHEREAS, Castle Development Corporation has made appli- <br />cation pursuant to ~40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended, for the granting and approval of a <br />Group Housing Project known as Olde Towne Condominiums; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Co~Lmission to have met the requirements of S40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> ~EREAS, the Planning CoI~mission has reviewed such appli- <br />cation and site plans submitted therewith and has recommended <br />approval of said application; and <br /> <br /> W~EREAS, the developer has beer informed that approval <br />of the Group Housing Project pursuant to said ~40-55 grants <br />only an exemption from certain requirements for residences <br />as stated in said section and does not constitute a waiver <br />of any other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, the Code of %he City of Portsmouth, Virginia, <br />or any other applicable local, state or federal laws or re- <br />gulations; and <br /> <br /> [~EREAS, the developer is aware that building permits <br />or any other required permit will be issued only upon compliance <br />with the ordinances, laws or regulations applicable thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City <br />of Portsmouth, Virginia, %hat the certain Group Housing Project <br />known as Olde Towne Condominiums and designated as GHP-83-3, <br />and ~ore specifically shown on plans prepared by CMSS Architects <br />for Castle Development Corporation consisting of a site plan, <br />floor plans and perspective drawing and filed with the appropriate <br />officials of the City of Portsmouth, Virginia and made a part <br />hereof, is hereby granted approval; provided, however, that the <br />floor plans be amended so that the minimum required floor area <br />for each dwelling unit, exclusive of garage and patios, be six <br />hundred (600] square feet. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held May 24, 1983. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
