(53) townhouse/ <br />site and that all <br /> <br /> 1. That no more than fifty-three <br />condominium units will be built on this <br />units will sell in excess of $75,000.; <br /> <br /> 2. That all of the streets, utilities and maintenance <br />services will be the responsibility of the developer and the <br />condominium association; <br /> <br /> 3. That recreational facilities will be included in <br />the form of co~ur~on open areas. Passive recreation will be <br />offered in the fo~uu~ of a waiting trail from Sandie Point <br />Road to and along the proposed bulkhead along the waterfront <br />as well as an open green area in the center of the develop- <br />ment. Active recreation will be offered through the develop- <br />ment of the abandoned railroad trestle into a pier and boat <br />slip facility for Sandie Point residents. Twenty (20) to <br />thirty (30) boat slips will be provided which will be built <br />either on floating docks or fixed piers and such boat slips <br />would be joined by way of a r~mp and stairway connection to <br />the railroad trestle. The trestle would further be used for <br />such other recreational purposes as fishing, sunbathing, etc.. <br />The trestle walkway will be decked to-provide a suitable walk- <br />way and railings as necessary for safety; <br /> <br /> 4. A final landscape plan shall be submitted to the <br />Office of Pia~nin~ for the City of Portsmouth for review and <br /> t..e Cmty Planning staff prior to the issuance of <br />approval by h ~ <br />any building per, its. <br /> <br /> 5. The condominium will be governed~under the condominium <br />laws of Virginia and a site plan for the condominium conforming <br />to the specifications required by Section 55-79.58 of the <br />Code of Virginia shall be filed with the appropriate Cit~ officials; <br /> <br /> 6. The de~loper shall resurface Locust L~he to twenty- <br />four ~24) feet wide and the length of approximately four hundred <br />(400) feet from the development site to Windsor Road. The cost <br />of this resurfacing and the maintenance and upkeep of this <br />section of Locust Lane will be tha responsibility of the <br />developer and the condominium association for all times in <br />the future. <br /> <br />, 7 Additionally, the developer shall resurface an add- <br />ltmonal port,on o~ Wmndso~ Road not to exceed?5 tlnear feet <br />to 24 feet wlde; however, future upkeep and maintenance of <br />this addition will not be deemed a responsibility of the <br />developer and/or the condominium association. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia, <br />at a meeting held April 26, 1983. <br /> <br />Teste: <br /> <br /> <br />
