26 <br /> <br />~ RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO SECTION 40-55 OF THE CODE OF THE CiTY OF PORTSMOUTH, <br />VIRGINIA, 1973, AS A-MENDED, SAiD PROJECT BEING KNO~%~ AS "SANDiE <br />POINT" AND DESIGNATED AS GHP-83-1. <br /> <br /> ~HEREAS, Donald H. Sandie has made a~pllcatlon~ · ' pursuant <br />to Section 40-55 of the Code of the City of Portsmouth, Virginia, <br />t973, as amended for the <br /> , grant_ng and approval of a G~oup Housing <br />Project for the construction of a fifty-three (53) unit townhouse/ <br />condominium development known as "Sandie Point"; and <br /> <br /> WHEREAS, the application has been determined by the Plan- <br />ning Commission to have me% the requirements of Section 40-55 <br />ofand the Code of the City of Portsmouth, Virginia, 1973, as amended; <br /> <br /> WHEREAS, the Planning Commission has reviewed such appli- <br />cation and site plans submitted~ ' therewl=h'= and has recommended <br />approval of said application; and <br /> <br /> ~EREAS, the developer has been info.ed that the approval <br />of the Group HousingProject ~ursuant to said Section 40-55 <br />grants only an exemption from certain requirements for residences <br />as stated in said section and does not constitute a waiver of <br />any other requirement embodied in the Subdivision Ordinance, <br />Zoning Ordinance, the Code of the City of Portsmouth, or anv <br />andother applicable local, state, or federal laws or regulations; <br /> <br /> WHEREAS, the developer is aware that building permits or <br />any other required permit will be issued only upon compliance <br />withand the ordinances, laws, or regulations applicable_ thereto; <br /> <br /> WHEREAS, the developers have Proffered certain terms and <br />conditions for the condominium pro~osa!, and this City Council <br />has considered such terms and conditions together with the <br />recommendation of the City Planning Co~umission. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the <br />City of Portsmouth, Virginia, that the certain Group Housing <br />Project known as "Sandie Point" and designated as GHP-83-4, <br />and more specifically shown on plans and the outline specifications <br />prepared by the Office of Dan E. Griffin. Kenneth M. Sedlacko, <br />designated 8252 dated February, 1983, and filed with the <br />appropriate officials of the City of Portsmouth, Virginia <br />and made a part hereof, is hereb~ granted approval subject <br />to the following terms and conditions as proffered by the <br />developer by a letter dated March 15, 1983: <br /> <br /> <br />
