21 A RESOLUTION EXPRESSING THE CONCERN OF THE COUNCIL OF THE CITY OF PORTSMOUTH RELATIVE TO ACTIONS TAKEN BY COX CABLE OF PORTSMOUTH. WHEREAS, effective Marc~ 15, 1983, the Copyright Royalty Tribunal increased t/ge Copyrlg_~th Royalty Fees by nine ('9) percent; and WHEREAS, Cox Cable of Portsmouth, Inc. has announced that, as a result of such action and pursuant to frs study of the law~ research of the potential effects and survey of its subscribers, it will impose an eighty-one ($0.81) cent Copyright Royalty Fee per basic subscriber per month in order to comply with the Copyright Royalty Fee mandate; and WHEREAS, the imposition of this fee was conm~enced without consideration by the C~eV Council; and WHEREAS, Cox Cable provides a unitary system serving the cities of Norfolk and Virginia Beach as well as Portsmouth and has imposed the additional fee on the citizens of those cities as well~ and Wi.~qEREAS~ the Council of the City of Portsmouth is concerned about the imposition of the fee on the citizen subscribers and hhe validity of Cox's action in imposing such fee without the concurrence of City Council. NO~, ~Ei -~ RE.~RE~ BE IT RESOLVED that the Council of the City of Portsmouth directs the City Manager and the City Attorney and a representative of the Cable Television Co~m- ission to meet with officials of Cox Cable of Portsmouth, Inc.. BE IT FURTHER RESOLVED that this Council request Cox Cable of Portsmouth, Cox Cable of Virginia Beach and Co~ Cable of Norfolk to call a meeting of appropriate officials of each of the affected communities to discuss this issue on a reg±ona! basis. BE IT FURTHER RESOLVED that this Council Cable of Portsmouth, Inc. to defer collection Royalty Fee until this matter is resolved. request Cox of the Copyright Adopted by the Council of the City of Portsmouth, Virginia, at a meeting held April 1, 1983.
