A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING <br />PROJECT PURSUANT TO SECTION 40-55 OF THE CODE OF THE <br />CITY OF PORTSMOUTH, VIRGINIA, 1973, SAID PROJECT BEING A <br />SIX (6) UNIT CONDOMINIUM ON A PARCEL TO THE NORTH OF BAY <br />STREET BETWEEN LINDEN AVENUE AND WEBSTER AVENUE AND <br />DESIGNATED AS GHP-85-20. <br /> <br />57 <br /> <br /> WHEREAS, Gerald F. Martin for William Sprott~ <br />owner, has made application pursuant to Section 40-55 of <br />the Code of the City of Portsmouth, Virginia, 1973, for <br />the granting and approval of a group housing project <br />consisting of a six (6) unit condominium on a 0.348 acre <br />parcel to the north of Bay Street between Linden Avenue <br />and Webster Avenue; and <br /> <br /> WHEREAS, the application has been determined by the <br />Planning Commission to have met the requirements of <br />Section 40-55 of the Code of the City of Portsmouth, <br />Virginia, 1973, as amended; and <br /> <br /> WHEREAS, the Planning Commission has reviewed said <br />application and site plans submitted therewith and has <br />recommended a conditional approval of said application; <br />and <br /> <br /> WHEREAS, the developer has been informed that <br />approval of a group housing project pursuant to Section <br />40-55 grants only an exemption from certain requirements <br />for residences as stated in said section, and does not <br />constitute a waiver of any other requirement embodied in <br />the Subdivision Ordinance, Zoning Ordinance, Code of the <br />City of Portsmouth, Virginia, or any other applicable <br />local, state, or federal law or regulation; and <br /> <br /> WHEREAS, the developer is aware <br />permits or any other required permit <br />upon compliance with the ordinances, <br />applicable thereto. <br /> <br />that building <br />will be issued only <br />laws or regulations <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of <br />the City of Portsmouth, Virginia, that the certain group <br />housing pro3ect consisting of six (6) condominium units <br />on a 0.348 acre parcel to the north of Bay Street <br />between Linden Avenue and Webster Avenue and designated <br />as GHP-85-20, and more specifically described in <br />correspondence from Gerald F. Martin, Architect, dated <br />April 10, 1985 as shown on plans designated "Six Unit <br />Condominium For Bill Sprott-Portsmouth, Virginia," and <br /> <br /> <br />
