AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, 1973, AS AMENDED~ BY AMENDING SECTION 30-4 <br />THEREOF, PERTAINING TO THE OBSTRUCTION OF cITY STREETS BY <br />RAILROAD CARS, ETC.. <br /> BE IT ORDAINED by the Council of the City of Pbrtsmouhh~ <br /> Virginia: <br /> 1. That Section 30-4 of Chapter 30 of the code of the <br /> City of Portsmouth, Virginia, 1973, be amended and reordained <br /> to read as follows: <br /> Section 30-4. Railroad cars obstructing street; standing <br /> vehicle on track. <br /> It shall be unlawful for any railroad company, or any <br /> receiver or trustee operating a railroad, to obstruct for <br /> ive (5) minutes, the free passage on <br /> a longer ~er!od than f ~ - -~ or trains acroSs the same, <br /> r i ~- road, by stan~ln~ <br /> any stree~ uz ~_l~ .... hile receiving or dzscnargmng <br /> except a passenger Li~l~ <br /> passengers, but a passway shall be kept o~en to allo~ <br /> normal flow of traffic; nor shall it be l~wful to stand <br /> any wagon or other vehicle on the track of any railroad which <br /> will hinder or endanger a moving train; provided, that when <br /> a train has been uncoupled, so as to make a passway, the <br /> time necessarily required, not exceeding three (3) minuteS, <br /> to pump up the air after the train has been recoupled shall <br /> not be included in considering the time such cars or trains <br /> were standing across such stree% or road. Any such railroad <br /> company, receiver or trustee, violating any of the provisions <br /> of this section shall be fined not less than one hundred <br /> ($100.) nor more than five hundred ($500.) dollars; provided <br /> that the fine may be one hundred dollars ($100.) for each <br /> minute beyond the permitted time but the total fine shall <br /> not exceed five hundred ($500.) dollars. <br /> This section shall not apply when the train is stopped <br /> due to breakdown, mechanical failure or e~ergency. <br /> 2.
