AN ORDINANCE TO AMEND CHAPTER 30 OF THE CODE OF THE CITY OF PORTSMOUTH, 1973, AS AMENDED~ BY AMENDING SECTION 30-4 THEREOF, PERTAINING TO THE OBSTRUCTION OF cITY STREETS BY RAILROAD CARS, ETC.. BE IT ORDAINED by the Council of the City of Pbrtsmouhh~ Virginia: 1. That Section 30-4 of Chapter 30 of the code of the City of Portsmouth, Virginia, 1973, be amended and reordained to read as follows: Section 30-4. Railroad cars obstructing street; standing vehicle on track. It shall be unlawful for any railroad company, or any receiver or trustee operating a railroad, to obstruct for ive (5) minutes, the free passage on a longer ~er!od than f ~ - -~ or trains acroSs the same, r i ~- road, by stan~ln~ any stree~ uz ~_l~ .... hile receiving or dzscnargmng except a passenger Li~l~ passengers, but a passway shall be kept o~en to allo~ normal flow of traffic; nor shall it be l~wful to stand any wagon or other vehicle on the track of any railroad which will hinder or endanger a moving train; provided, that when a train has been uncoupled, so as to make a passway, the time necessarily required, not exceeding three (3) minuteS, to pump up the air after the train has been recoupled shall not be included in considering the time such cars or trains were standing across such stree% or road. Any such railroad company, receiver or trustee, violating any of the provisions of this section shall be fined not less than one hundred ($100.) nor more than five hundred ($500.) dollars; provided that the fine may be one hundred dollars ($100.) for each minute beyond the permitted time but the total fine shall not exceed five hundred ($500.) dollars. This section shall not apply when the train is stopped due to breakdown, mechanical failure or e~ergency. 2. That this ordinance shall be effective as of of its adoption.
