AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 33-1, 33-22, 33-55 AND <br />33-57 (a) (2) PERTAINING TO SUBDIVISIONS. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Sections 33-1, 33-22, 33-55 and 33-57 (a) (2) of <br />the Code of the City of Portsmouth, Virginia, 1973, be amended <br />to read as follows: <br /> <br />Section 33-1. Authority and purpose. <br /> <br /> This Chapter is adopted pursuant to the te~ms and <br />provisions of the Code of Virqinia, 1950, as amended. The <br />purpose of this Chapter is to-provide for the harmonious and <br />economic development of the City of Portsmouth; for the orderly <br />subdivision of land and its development; for the orderly <br />development of the general area surrounding such subdivision or <br />section thereof; for the coordination of streets within such <br />subdivision or section thereof with other existing or planned <br />streets within the general area; for adequate provisions for <br />drainage, flood control, light, air and other public purposes; <br />for the adequate and proper installation of streets, drainage, <br />sanitary sewers, water and other utilities and facilities <br />dedicated for public use, and maintained by the City and for the <br />provision of other site related improvements required by local <br />ordinances for vehicular ingress and egress, for public access <br />streets, for structures necessary to insure stability of <br />critical slopes, and for storm water management facilities; for <br />the dedication to the City of land for streets, alleys or other <br />public purposes or the transfer to the City of easements or <br />other rights or privileges; and for the reservation for the City <br />of land to be acquired for public facilities. <br /> <br />Section 33-22. Recordation. <br /> <br /> Unless the subdivider shall record his approved final <br />subdivision plat in the office of the Clerk of the Circuit Court <br />of the City within thirty (30) days after the planning director <br />and city engineer have affixed their signatures thereto, the <br />said final plat approval shall be null and void. The subdivider <br />or his agent shall, in writing, inform the planning director of <br />the date on which the said final subdivision plat was filed and <br />note the Map Book and page number thereof. <br /> <br /> Provided, however, if a subdivider records a final plat <br />which may be a section of a subdivision as shown on an approved <br />preliminary plat and furnishes to the City a certified check, <br />cash escrow, bond or letter of credit in the amount of the <br />estimated cost of construction of the facilities to be dedicated <br />within said section for public use and maintained by the City, <br />the developer shall have the right to record the remaining <br />section or sections shown on the preliminary plat for a period <br />of five (5) years from the recordation date of the first <br /> <br /> <br />
