(b) Term of office. The animal wardens shall hold <br />office at the pleasure of the City Manager. <br /> <br /> (c) Salary. The animal wardens shall receive such <br />salary as may be fixed by the City Council. <br /> <br /> (d) Powers, duties. The animal wardens shall have <br />police powers and be charged with the duty to enforce the <br />provisions of this Chapter as well as the hunting, trapping, <br />inland fish and dog laws of the State and this Code. <br /> <br />Section 4-23. Running at large. <br /> <br /> (a) It shall be unlawful for any person who owns, keeps, <br />or harbors a dog or has it in his care, or who acts as its <br />custodian, or who permits a dog to remain on or about a premises <br />occu~ied~ by himf to allow such dog to run at large unless such <br />dog is accompanied by an attendant, and held leashed by a <br />responsible person or securely muzzled with a muzzle, the <br />character of which shall have been approved by the animal <br />warden or animal control officer of the City of Portsmouth. <br /> <br /> (b) For the purpose of this section, a dog shall be deemed <br />to run at large while roaming, running, or self-hunting off the <br />proper~y of its owner or custodian and not under its owner's <br />or custodian's immediate control. Any person who permits a <br />dog to run at large or r~main unconfined, unrestricted or not <br />penned up, shall be deemed to have violated the provisions <br />of this section, and guilty of a Class 4 misdemeanor. <br /> <br />Section 4-24. <br /> <br />Impoundment of dogs running at large without <br />leash or muzzle. <br /> <br /> (a) Required. It shall be the duty of the animal warden <br />to catch and turn over to the Portsmouth Humane Society, Inc. <br />for impounding, all do~s found off the owner's premises, unless <br />such dog is accompanied by an attendant, held in leash by a <br />responsible person or securely muzzled, as provided in Section <br />4-23. <br /> <br /> (b) Notice. If any dog is impounded pursuant to sub- <br />section (a) of this section, it shall be the duty of the animal <br />warden if the rightful owner may be readily identified, to <br />notify the owner within forty-eight ~48) h~urs, next following <br />its confinement. <br /> <br /> (c) Duration; redemption. Every dog impounded pursuant <br />to subsection (a) of this section shall be penned for five (5) <br />days, such period to coranence on the day immediately following <br />the day the dog is initially confined in the Portsmouth Humane <br />Societ~ facility, during which time it may be redeemed by the <br />owner ~y paying to the attendant at the dog pound the sum of <br /> <br /> <br />
