AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, <br />1973, BY AMENDING SECTION 23-293 THEREOF, AND BY ENACTING SECTION <br />23-294 PERTAINING TO PORTSMOUTH PARKING AUTHORITY LOTS AND GARAGES. <br /> <br /> ~E <br />Virginia: <br /> <br /> 1 <br />Portsmouth, <br /> <br />IT ORDAINED by the Council of the City of Portsmouth, <br /> <br /> That Section 23-293 of the Code of the City of <br /> Virginia, 1973, be amended to read as follows: <br /> <br />Section 23-293. Violation of regulations of Portsmouth Parking <br /> Authority. <br /> <br /> (a) It shall be unlawful for any person to violate any <br />regulation of the Portsmouth Parking Authority relating to parking on <br />lots or in garages controlled, operated or used by said authority for <br />the purpose of providing parking for the general public, violators <br />shall be proceeded against as hereinafter set forth. <br /> (b) It shall be the duty of the police officers of the <br />city, acting in accordance with instructions issued by the chief of <br />police to report, with regards to any violation of (a): <br /> (1) Where applicable, the number of each parking <br />meter or reserved space which is the subject of a violation of (a). <br /> <br /> (2) The state license number of each vehicle <br /> <br />occupying a metered or reserved space <br /> <br /> (3) The length of <br />parked in violation of (a). <br /> <br />in violation of (a). <br /> <br />time during which a vehicle is <br /> <br /> (4) Any other facts, a knowledge of which is <br />necessary to a thorough understanding of the circumstances attending <br />such violation. _ <br /> (c) Each such police officer shall attach to such vehicle <br />a notice to the owner thereof, that such vehicle has been parked in <br />violation of a provision of such regulation and instructing such owner <br />to report to the Portsmouth Police Department Headquarters in regard <br />to such violation. Each such owner may, within seventy-two (72) hours <br />of the time when such notice was attached to such vehicle, pay a <br />penalty in the sum of three dollars ($3.00) for each hour, or fraction <br />thereof, during which such vehicle occupied such parking space in <br />violation of any of the provisions of such regulation; provided, <br />however, that if such penalty is paid within one hour after the notice <br />is attached to such vehicle, then the amount of the penalty shall be <br />two dollars ($2.00) instead of three dollars ($3.00). If the owner of <br />such vehicle fails to make such payment within seventy-two (72) hours <br />of the time when such notice was attached to such vehicle, then an <br /> <br /> <br />
