Section 17-31. Inspection and Certificate Required. <br /> No owner, agent or person in charge of a <br />dwelling or dwelling unit shall allow any person to <br />occupy the same as a tenant or lessee or for a valuable <br />consideration unless said dwelling or dwelling unit <br />shall have been inspected immediately prior to the <br />vacancy and shall have been determined to be in <br />compliance with the provisions of the Southern Standard <br />Housing Code, 1969 Edition, as adopted by reference in <br />Section 17-16 or as amended in Section 17-18 of this <br />Code. such compliance shall be evidenced by a <br />Certificate of Compliance issued by the Director of <br />Housing Services and Community Development; provided, <br />however, no such inspection shall be required within one <br />hundred eight days (180) of the date of the last <br />Certificate of Compliance issued. <br /> Furthermore, no electric power company shall <br /> servlc to a <br /> commence individual · ' e dwelling unit unless it <br /> has determined that a valid and effective Certificate of <br /> Compliance has been issued therefor as hereinafter <br /> required or that a waiver as permitted by Section 17-34 <br /> has been granted. <br /> Section 17-36. Appeals from Director's Decision. <br /> Any applicant for a Certificate of Compliance <br /> required by this Division who deems himself aggrieved by <br /> a decision of the Director may appeal such decision <br /> within fifteen (15) days of receipt thereof in writing <br /> to the Housing Board of Adjustments and Appeals. If <br /> necessary, special meetings shall be called by the <br /> Chairman of said Board in order that such appeals may be <br /> promptly decided. <br /> Section 17-48. Hazardous Conditions and Notice of <br /> Abatement. <br /> When the Director determines that the presence <br /> of lead-based paint or lead-bearing substance upon any <br /> interior surface or exterior surface accessible to <br /> children of a dwelling, dwelling unit, rooming house, <br /> rooming unit, or facility creates a health hazard, he <br /> shall issue a notice and demand for abatement to the <br /> owner. Personal notification or notice by mail shall <br /> constitute adequate notice. A mailing of a notice by <br /> first class mail to the owner's last known address as <br /> obtained ~rom any reliable source shall be prima ~acie <br /> evidence that the owner has actually been notified. The <br /> Director's notice shall allow a reasonable time for <br /> correction of the condition, but this time shall not be <br /> less than ten (10) days.
