be turned on if the vehicle is equipped with such lights <br />and such lights are operating, and a report shall be <br />made to the nearest police officer as soon as <br />practicable, and the vehicle shall be removed from the <br />roadway to the shoulder a~ soon as possible and removed <br />from the shoulder without unnecessary delay. If the <br />vehicle is not promptly removed, such removal may be <br />ordered by a police officer at the expense of the owner <br />if the disabled vehicle creates a traffic hazard. <br /> <br /> (b) The provisions of subsection (a) shall not <br />apply to any vehicle owned or controlled by the <br />Commonwealth of Virginia, Department of Highways and <br />Transportation, or any unit of local government, while <br />actually engaged in the construction, reconstruction or <br />maintenance of highways. <br /> <br />Section 23-229. <br /> <br />Parking in spaces reserved for <br />handicapped persons. <br /> <br /> It shall be unlawful for a nonhandicapped driver of <br />a motor vehicle to park in a parking space reserved for <br />the handicapped at privately owned shopping centers, <br />business offices, or parking lots or on the streets or <br />public grounds of the city, unless such driver is using <br />the motor vehicle to transport a handicapped person who <br />has obtained a special vehicle parking permit from the <br />Commissioner. For purposes of this section, the term <br />"nonhandicapped driver" shall mean the driver of a motor <br />vehicle who has not been issued a license plate, permit, <br />or decal by the Commissioner designating such person as <br />handicapped. The license plate issued by the <br />Commissioner to a motor vehicle shall be attached to <br />such motor vehicle as required by Section 23-408. The <br />decal or permit issued by the Commissioner must be <br />displayed in the front windshield of the motor vehicle <br />when such vehicle ts parked in a parking space reserved <br />for the handicapped. Spaces reserved for the handicapped <br />shall be identified by above-grade signs. A violation <br />of this section shall constitute a traffic infraction. <br /> <br /> It shall be the duty of each police officer or <br />other uniformed personnel employed by the city to <br />enforce parking regulations to give to any person <br />operating a motor vehicle parked in violation of this <br />section a notice, or to attach to the vehicle found so <br />parked a notice to the owner, that such vehicle has been <br />illegally parked in violation of this section and <br />instructing him to report to the Portsmouth Police <br />Department Headquarters. Each person so notified may <br />within seventy-two (72) hours from the time when such <br />notice was given or attached to the vehicle pay the sum <br />of twenty-five dollars ($25.00) due to his vehicle <br />being illegally parked in violation of this section. <br /> <br /> <br />
