25 A RESOLUTION GRANTING A USE PERMIT TO THE PORTSMOUTH BAPTIST ASSOCIATION FOR THE EMILY GREEN HOME AT 410 ~D 500 WESTMORELAND AVENUE. WHEREAS, the Portsmouth Baptist Association has made application pursuant to ~40-76 (b) of the Code or-the City of Portsmouth, Virginia, 1973, for the granting of a use permit as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said~se permit. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the pro- posed use; injurious and (b) Will not be detrimental to the public use or to the property or improvements in the neighborhood; (c) Will be in accordance with 'the purposes of the Zoning Chapter of the City Code. 2. Portsmouth Baptist Assiciation is hereby granted a use permit to operate the Emily Green Home as a group home for adults pursuant to ~40-76 (b) of the City Code at the property described as follows: UP-84-3 BEGINNING at a point on the west right-of- way of Westmoreland Avenue 60~ + north from its intersection with King Street; Thence north a- long said right-of-way 320' ~; thence west 175' + to the water line of Baines Creek; thence ~outherly along said water line to the north right-of-way of King Street, a distance of 420' +; thence east along said right-of-way 195' +; Thence north 60'; thence east 90' to the wes~ right-of-way of Westmoreland Avenue, thepoint of beginning.
