7. The Grantee shall maintainits wires, poles, conduits, <br />manholes, and other property in good and safe 'order and condition, <br />and shall at all times f~lly indemnify, protect and save harm- <br />less ~he Grantor and~its offic±als from all suits and actions <br />due to the negligence of the Grantee and its employees, and <br />from the existence of the property of the Grantee on the streets <br />and public places of %he City.. <br /> <br /> The Grantee, upon notice of the presentation of such a <br />claim, or the institution of an action or suit upon any such <br />claims, shall defend such action or suit without cost to the <br />City, and shall~fully pay and satisfy within thirty (30) days <br />after final judgment any judgment rendered against the Grantor <br />or its officials upon such claim. Nothing herein contained <br />shall prevent the Grantor from investigating and defending <br />such claim. <br /> <br /> 8. The rights and privileges hereby granted shall con- <br />tinue for the period of fifteen (15) Fears from and after the <br />final passage of this ordinance, and shall automatically be <br />renewed for a like period unless written notice Of its desire <br />to terminate this franchise at the expiration of said original <br />fifteen (15) year period be given by either party to the other <br />party prior to the expiration of the fourteenth (14th) year <br />of said original fifteen (15) year period; unless the same be <br />sooner vol%Lntarily surrendered by the said Grantee with the <br />consent of the Grantor or unless the same be sooner forfeited <br />as provided by law. <br /> <br /> Upon the expiration of this grant and upon termination of <br />the rigkts hereby granted, by surrender, forfeiture, or other- <br />wise, all of the poles, wires, conduits, lines and other pro- <br />perty of the Grantee in the streets, alleys or public places <br />of the Grantor may be removed at the expense of the Grantee <br />within a reasonahle time after the expiration or termination <br />of said rights and privileges, provided, however, that such <br />removal shall first be authorized by the appropriate state <br />and federal regulatory bodies having jurisdiction. <br /> <br /> 9. Nothing in this ordinance shall be construed to <br />pre~ent the Grantor from levying any lawful tax on the pro- <br />perties or business of the Grantee. <br /> <br /> 10. The rights and privileges herein-'set forth are granted <br />upon the condition and with the express understanding on the <br />part of the Grantee that the Grantee wi'il render to the in- <br />habitants of the City of Portsmouth an adequate and efficient <br />telephone service at reasonable rates, and that it will main- <br />tain its properties located within the liraits of the City in <br /> <br /> <br />
