good order and condition, and that the rights and privileges herein granted shall be SUbject to all lawful ordinances now in effect or hereafter adopted under the police powers vested in the Council of the City of Portsmouth, or in the regulation of public service corporations in the City. 11. Nothing in this ordinance shall be construed to grant to the Grantee any exclusive right of franchise. 12. Ail bids for the franchise, rights and privileges hereby granted shall be submitted in'writing as required by law, and each bidder shall file wi~h his bid a certified check drawn on a bank authorized to do business in Uirginia executed in favor of the Grantor, for the sum of Five Thousand Dollars [$5,000) Which shall be held'by the City Clerk upon the following conditions: La) That if the bid is accepted and an ordinance substantially in the form of this ordinance is passed granting to the bidder the fran~se, rights and privileges herein set forth, then the bidder will, within thirty days (30) from and after the time at'which this ordinance shall become effective, file a written acceptance of same with the City Clerk sub- stantially in the form hereto annexed. Cb) That st the same time said written acceptance is filed, the bidder wilt execute and file with the City Clerk a bond in favor of the Grantor in the amount of Five Thousand Dollars ($5,000) with good and sufficient security, and will at all times comply with all terms, conditions, and obligations imposed by this ordinance, and will pay the cost of the adver- tisement · hereof. In the event of the failure of said bidder, whose bid is accepted and to whom said grant is made, to so file said written acceptance or give such bond within the time herein befcr~ prescribed, then the said certified check accompanying said bid shall thereupon ipso facto be forfeited to the Grantor, and shall immediately be and become the absolute property of and payable to Grantor, without offset, as liquidated damages. Upon the acceptance by the Council of the bid of the successful bidder, the City Clerk shall return to the unsuccess- ful bidders his certified check filed by them respectively with their bids, and shall hold the check of the successful bidder until the written acceptance and bond required under SS12 and 13 of this ordinance shall have been filed. Thereupon said City Clerk shall return to such successful bidder the certified check accompanying the Grantee's bid as aforesaid, and shall hold the bond given by said Gran~ee upon the conditions herein specified.
