AN ORDINA~NCE GRANTING A FRANCHISE TO ITS SUCCESSORS AND ASSIGNS, TO USE THE STREETS AND OTHER PUBLIC PLACES OF THE CIHY OF PORTSMOUTH, VIRGINIA, FOR ITS POLES, WIRES, CONDUETS, CABLES AND FIXTURES, NECESSARY FOR T~E OPERATION OF A TELEPHONE SYSTEM. BE IT ORDAII~ED by the Council of the City of Portsmouth, Virginia, that: 1. The City of Portsmouth (hereinafter called "Grantor") hereby grants to its successors and assigns, (hereinafter called "Grantee") upon the terms and ~conditions hereinafter set out, the franchise, right, and privilege to operate, construct, and maintain for the term specified in Section 8 hereof, a telephone system with the necessary poles, wires, conduits and fixtures in, under, over and along the streets, alleys, highways, and public places of the City of Portsmouth, as the corporate limits of said City now exist, or may hereafter be extended or altered, with the right to use the property of other companies, and to permit other companies to use i~s property upon such arrange- ments as the companies in question may agree. 2. Ail poles erected by the Grantee shall be neat and symmetrical, and shall be so located as to in no way interfere with the safety or convenience of persons using the public streets and public places, and in the installation and main- tenance of its underground system the Grantee shall not open or encumber more of any street or other public place than will be necessary or enable it to perform the work with proper economy and efficiency. The Grantee in the construction and maintenance of its underground system shall-not interfere with or injure any sewer, water main~ or other apparatus of the Grantor, or the property of any other person. The Grantee shall be required to relocate at its own expense any conduits or poles which interfere with the sewers, water mains, or otherpubtic work of the Grantor, or which may be necessary due to the change of the Grantor, or which may be necessary due to the change in location or grade of .any street or from a~y public improve- ment by the Grantor. In the e~ent o.f the Grantee's failure to relocate its property after reasonable notice from the Grantor, the Grantor may cause the same to be relocated and recover the cost thereof from the Grantee. 3. Whenever the Grantee shall desire to use any of the streets, h~ghways, or other public places, to erect, lay or construct any poles, conduits or manholes, it shall prepare and place on file with the Director of Plann%ng, Inspections, and Engineering of the Grantoror such other representative so designated by the City Manager, plans of such proposed con-
