AN ORDINA~NCE GRANTING A FRANCHISE TO <br />ITS SUCCESSORS AND ASSIGNS, TO USE THE STREETS AND OTHER <br />PUBLIC PLACES OF THE CIHY OF PORTSMOUTH, VIRGINIA, FOR ITS <br />POLES, WIRES, CONDUETS, CABLES AND FIXTURES, NECESSARY FOR <br />T~E OPERATION OF A TELEPHONE SYSTEM. <br /> <br /> BE IT ORDAII~ED by the Council of the City of Portsmouth, <br />Virginia, that: <br /> <br /> 1. The City of Portsmouth (hereinafter called "Grantor") <br />hereby grants to <br />its successors and assigns, (hereinafter called "Grantee") upon <br />the terms and ~conditions hereinafter set out, the franchise, <br />right, and privilege to operate, construct, and maintain for <br />the term specified in Section 8 hereof, a telephone system <br />with the necessary poles, wires, conduits and fixtures in, <br />under, over and along the streets, alleys, highways, and public <br />places of the City of Portsmouth, as the corporate limits of <br />said City now exist, or may hereafter be extended or altered, <br />with the right to use the property of other companies, and to <br />permit other companies to use i~s property upon such arrange- <br />ments as the companies in question may agree. <br /> <br /> 2. Ail poles erected by the Grantee shall be neat and <br />symmetrical, and shall be so located as to in no way interfere <br />with the safety or convenience of persons using the public <br />streets and public places, and in the installation and main- <br />tenance of its underground system the Grantee shall not open <br />or encumber more of any street or other public place than <br />will be necessary or enable it to perform the work with proper <br />economy and efficiency. <br /> <br /> The Grantee in the construction and maintenance of its <br />underground system shall-not interfere with or injure any <br />sewer, water main~ or other apparatus of the Grantor, or the <br />property of any other person. The Grantee shall be required <br />to relocate at its own expense any conduits or poles which <br />interfere with the sewers, water mains, or otherpubtic work <br />of the Grantor, or which may be necessary due to the change <br />of the Grantor, or which may be necessary due to the change <br />in location or grade of .any street or from a~y public improve- <br />ment by the Grantor. In the e~ent o.f the Grantee's failure to <br />relocate its property after reasonable notice from the Grantor, <br />the Grantor may cause the same to be relocated and recover the <br />cost thereof from the Grantee. <br /> <br /> 3. Whenever the Grantee shall desire to use any of the <br />streets, h~ghways, or other public places, to erect, lay or <br />construct any poles, conduits or manholes, it shall prepare <br />and place on file with the Director of Plann%ng, Inspections, <br />and Engineering of the Grantoror such other representative so <br />designated by the City Manager, plans of such proposed con- <br /> <br /> <br />
