77 A RESOLUTION GRANTING A USE PERMIT TO MARILYN W. JENNINGS, DIRECTRESS, MONTESSORI CHILDREN'S CENTER, TO OPERATE A PRESCHOOL/ KINDERGARTEN FACILITY IN THE GREEN LAKES BAPTIST CHURCH AT 1610 HODGES FERRY ROAD. WHEreAS, by resolution adopted September 27, 1983, the Council of the City of Portsmouth, Virginia, granted a use permit to Carol R. Ullom, Directress, Montessori Children's Center, to operate a preschool/kindergarten facility in the Green Lakes Baptist Church at 1610 Hodges Ferry Road (UP-83-16); and WHEREAS, Marilyn W. Jennings, with the permission of Green Lakes Baptist Church, has made application pursuant to ~40-73 (b) of the Code of the City of Portsmouth, Virginia, 1973, to transfer said-use permit, and to expand the facility from twenty-five (25) children to fifty (50) children; and WHERRAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit subject to the conditions contained herein. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the use permit is sought: of persons use; (a) Will not adversely affect the health and safety residing or working in the neighborhood of the proposed (b) Will not be detrimental to the public use or injurious to the property or improvements in the neighborhood; and (c) Will be in accordance with the purposes of the Zoning Chapter of the City Code. 2. Marilyn W. Jennings, Directress, Montesorri Children's Center, is hereby granted a use permit pursuant to ~40-73 (b) of the City Code to operate a preschool/kindergarten facility in the Green Lakes Baptist Church, 1610 Hodges Ferry Road.
