A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING ~ROJECT PLTRSUANT TO SECTIO~ 40-55 OF THE CODE OF THE CITY ~F POP. TS- MOUTH, VIRGINIA, 1973, AS ~ENDED, SAID PROJECT BEING DESIC~AT~D AS GHP-83-8~ WHF:REAS, James V. Bickford has m. ade applicatio~ pursuant to ~40-55 of the Code of the City of Portsmouth~ Virginia~ 1973, as amended, for the granting and approval of a grou~ housing project consisting of forty-fiv~ (45) to%~nhouse apa~tm~ent units on a 3.5 acre site south of Peppe~vood Court north of the I~est- ern Freeway right-of-way and west of To~e Point Road (Tax Plate 845, Parcel 4); and WHEREAS, the application has been determined~k~ the Planning Comm!ssion to have met the requirenuents of ~40-55 of~ the Code of the City of Portsmouth, Virginia, 1973, as amended ~ and ~m/~EREAS, the Planning Co~uission has revie~ed~ such appli- cation and site plans submitted therewith, and has recommende~ approval of said application; and WHEREAS, the developer has been informed that approval of the group housing project pursuant to said ~40-55 grants only an exemption from certain requiremen_ts for residences as stated in said section and does not constitute ~ ~aiver of any requirement emJ0od±ed in the Subdivision Ordinance, Zoning Ordinance, the Code of the City of Ports_~_ou~, or any other applicable local, state or federal la9~ or re~alation; and WHEREAS, the developers are a%~are that buildira~ permits or other required permits will be issued only upon~ compliance · ~ith the ordinances, laws or regulations applicabl~ thereto. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia that the certain group housing project designated as GHP-83-8 and more specificall~ shown on plans prepared by C. Raeford Eure, S,drveyor, P. C. , dated November 8, 1983~ and submitted with correspondenc~ f~om the Bickford Company dated December 15, 1983, suck plans a~d document having been filed with the appropriate officials of the City of Portsmouth, Virginia and made a part he3ceof is hereby granted approval subject to the following te_rras and conditions: 1. A detailed landscape plan shall be submitte~ to the Office of Planning of the City of Portsmouth for ~eview and aoorovat by the City Planning staff prior to t~e issuance of an~-buildin~ permit, such landscape plan to inc!~de: (a) landscape buffer in southweste~corner between existing homes and townhouses; and
