6 <br /> <br />A P~SOLUTION GRANTING APPROVAL FOR A GROUP HOUSING PROJECT <br />PURSUANT TO ~40-55 OF THE CODE OF THE CITY OF PORTS_~4OUTH, <br />VIRGINIA, 1973, AS A~!ENDED, SAID PROJECT BEING A 10 UNIT <br />CONDOMINIUM STRUCTURE LOCATED AT ~_54 FLORIDA AVENUE <br />DESIGNATED AS C~HP-83-7. <br /> <br /> ~EREAS, Michael T. Rowe and Richard P. ~o!ena~r, has <br />made application pursuant to ~40-55 of the Code of the City <br />of Portsmouth, Virginia, 1973, as amended~ for the granting <br />and approval of a group housing project consisting of a ten <br />(10) unit condomini~ structure at 454 Florida Avenue~ and <br /> <br /> WHEREAS, the application has been determine~by the <br />Planning Con~ission to have met the requireme~.ts-~!~-§40-55 <br />of the Code of the City of Portsmouth, Virginia, 1973, as <br />amended; and <br /> <br /> %EqEREAS, the Planning Commission has reviewed such <br />app~lication and site plans submitted therewit-h and has <br />recorm~ended approval of said application; an~ <br /> <br /> WHEREAS, the developer has been informed that ~_~proval <br />6f the housing project pursuant to said ~.0-55 grants only <br />an exemption from certain requirements for residences as <br />stated in said section and does not constitute a waiver o~ <br />any other requirement e_utbodied in the Subdivision Ordinance, <br />Zoning Ordinance, Code of the City of Portsmouth, Virginia, <br />or any other applicable, local, state or federal la~ or <br />regulation; and <br /> <br /> WHEREAS, the developer is aware that building ~rmits <br />or ~ny other required permit will be issued only upon comt~!ianc~ <br />with the ordinances, laws or regulations applicabl~e thereto. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Co-uncil of ~he <br />City of Portsmouth, Virginia that the certain group housing <br />project consistin9 of a ten (10) unit condominium structure <br />to be constructed at 454 Florida Avenue and ~esignated as <br />GHP-83-7 and more specifically shown on nlans entitled "Olde <br />Porte, A Condominitn~-." filed with the appropriate officials <br />of the City of Portsmouth, Virginia and made a part hereof, <br />is hereby granted approval; provided, that a privac~ fence <br />six (6) feet in height be installed along the northern <br />property line from the rear of the structure to the alley. <br />A fence can then be extended beside the parking lot along <br />the alley and continue east around the parking lot along the <br />southern side of the sidewalk. <br /> <br /> Adopted by the Council of the City of Portsmouth, <br />Virginia at a meeting held January 24, 1984. <br /> <br />Te ste: <br /> <br />City Clerk <br /> <br /> <br />
