AN ORDINANCE CLOSING A PORTION OF AN UNNAMED ALLEY ON THE WEST <br />SIDE OF RODMAN AIFENUE. <br /> <br /> WHEREAS, Robert C. Barclay, III, attorney for Thor~s C. <br />Culpepper and others, has made application to vacate, close <br />and discontinue the hereinafter-described portion of a certain <br />public right-of-way and alley; and <br /> <br /> WHEREAS, by a resolution of this Council adopted January <br />10, 1984, viewers were appointed pursuant-to ~15.1-364, Code <br />of Virginia, 1950, as amended, to view the hereinafter-described <br />portion of said public right-of-way and alley, and to report <br />in writing whether in their opinion any, and if any, what in- <br />convenience would result from discontinuing said public right- <br />of-way and alley; and .< <br /> <br /> WHEREAS, the said viewers have reported in writing that <br />in their opinion an inconvenience would result in regards to <br />the collection of the trash and garbage; however, the Director <br />of Public Works had indicated that such services are provided <br />at the front of these properties along Western Branch Boulevard <br />and use of the subject alleyway for such service is not con- <br />templated; and <br /> <br /> WI{EREAS, the Planning Commission has recommended approval <br />of the application. <br /> <br /> NO~'~, THEREFORE, BE IT ORDAINED by the Council of the City <br />of Portsmouth, Virginia, that the hereinafter-described portion <br />of a certain alley located on the western side of Rod/nan Avenue <br />be closed and vacated as a public right-of-way and alley. <br /> <br />S-83-15 <br /> <br /> That portion of the alley 10' in width shown <br />on the plat of "~Taterview" duly recorded in the <br />Clerk's Office of the Circuit Court for the City <br />of Chesapeake, Virginia, in Map Book 17, pages 58 <br />and 59, running through the center of Block 4 and <br />along the western boundary of Block 4 (A) on said <br />plat which lies between the line drawn parallel to <br />and distant 300' S 34° 04' West from the eastern <br />line of Rockbridge'Road {formerly Loudoun Street) <br />which line is the prolongation northward of the <br />dividing line between Lots 13 and 14 in Block 4 <br />of said plat of "Waterview", and the west side of <br />Rodman Avenue as the same now exists after being <br />recently widened 10'. Said portion of the afore- <br />said alley is bounded by Parcels 5 and 9 on Tax <br />Map 355, Parcel 1 on Tax Map 354, and an unnunf0ered <br />parcel marked "City of Portsmouth" on both maps. <br /> <br /> <br />
