such accumulated contributions at any time if it finds that <br />such action is in the best interests of the retirement system. <br /> <br />Section 31-270. Ordinary death benefits. <br /> <br /> (a) Should a member, who had one or more years of <br />creditable service, die in service at any timebefore retire- <br />ment from a cause not compensable under t~e Virginia Workmen's <br />Compensatio~ Act, an additional benefit equal to five thousand <br />dollars ($5,000,00) shall then be payable in a lump sum in <br />accordance with Section 31-275. <br /> <br /> (b) Should a member die in service on or after July 1, <br />1977, who at any time has obtained a number of years of <br />creditable service required for entitlement to benefits under <br />the vesting provisions of Section 31-262, frem a cause not <br />compensable un~er the Virginia ~orkmen's Compensation Act, <br />t_here shall be paid a retirement 'allowance to the first of <br />the following listed persons who shall survive the member <br />and in the priority listed herein: <br /> <br />(1) rWidow or widower, pension payableduring widowhood. <br /> <br /> (2) Child or children under the age of eighteen (18) <br />years, pension uayable to age eighteen for each child. <br /> <br />(3) Dependent mother or father. <br /> <br />(4) ~ependent sist-er or brother. <br /> <br /> If there is more than one child, or more than one <br />dependent parent, or more than one dependentsister or <br />brother, the pension shall be divided in a manner as the <br />board may determine. Parents, brothers or sisters must <br />receive more than fifty (50) per cent support from the <br />member in order to be considered dependent for the purposes <br />of this pension. Payments to a child or children under the <br />age of e~ghteen (18) years shall be made only to a court- <br />appointed guardian or administrator of the estate of the <br />member. <br /> <br /> Such retirement allowance shall be payable to the first <br />eligible person as stipulated and shall be an allowance, <br />unless s~fosection (c) of this section is applicable, equal to <br />one-half (1/2~ of the retirement allowance that wouldhave <br />been payable to the ~e~ber had the member ~etired under the <br />provisions of Section 31-265 on the date of his death after <br />having elected to have his.allowance payable under the <br />joint and :last survivor option described in subsection (a) <br />(t~ of Section 31-274. tf the member is under the age ef <br />fifty-fiv~ (55) a~ the date of death, it shall be assumed for <br />the purpos~ of the one-half (1/2) 2oint an~ last survivor <br />option cal~cutation that the member be age fifty-five (55) at the <br />date of his death. <br /> <br />25 <br /> <br /> <br />
