(c) The compensation finally awarded to the member under <br />the Virginia Workmen's Compensation Act shall be duducted <br />from any allowance becoming payable under the~provisions <br />of this section, and %he ~xcess of the allowance, if any, <br />Shall be paid to the men, bet. ~fhen the t±me for payment of <br />compensation under such act has elapsed, the member shall there- <br />after receive the full a~ount of such allowance payable month- <br />ly during his lifetime and continued disability. <br /> <br />Section 31-268. Adjustments of retirement allowance. <br /> <br /> (a) Any person receiving a retirement allowance under <br />sections 31-263, 31-265, 31-267, 31-270 (b} or Section 31-274, <br />shall receive an adjustment of retirement allowance as of July <br />1st, each year, in an ~mount to be approved by the Council of <br />the City of Portsmoutk, ~Virginia. The amount of the adjustment <br />Shall be determined as a percentage of the retirement allowance <br />being received, including in percentage adjustment~ approved <br />in prior years. Such adjustments shall be s%%bject to the sa~e <br />conditions of payment as are applicable to the retirement <br />allowance. In no case shatlthe operation of this section <br />result in a reduction in th~ amount of any persons total a~ount <br />below the amount Of the retirement allowanc~ that Would have <br />been payable in the absence of this section. <br /> <br /> kb) For any person who continued employment beyond his <br />no~-mal retirement age, and who subsequently qualified for a <br />retirement allowance as provided under Section 31-262, such <br />allowance shall be adjusted by any percentage that may have <br />been authorized as provided in paragraph (a) of this section <br />during the interim between the person's normal retirement <br />age and 'his effective date of retirement allowance. <br /> <br />Section 31-269. Refund of accumulated contributions. <br /> <br /> (a) Upon the retirement of a mem3~er or upon his termi- <br />nation of servlce as an employee, other than by death, he <br />shall be paid, on demand, but not later than ninety (90) days <br />thereafter, the a~ount of his accumulated contributions, if any, <br />in a lump sum; provided that if the amount of such accumulated <br />eontributions is less than ten dollars ~$10.00), no such pay- <br />ment shall be made. <br /> <br /> (b) Should a member die at any time while in service, <br />the amount of his accu~u~atad contributions shall be paid in <br />a lump su~ in accordance with Section 31-275, provided that if <br />the amount of such accumulated contributions is less than <br />ten dollars ($10.00), no such payment shall be made. <br /> <br /> (c) Notwithstanding provisions of subsections (a) and (b) <br />of this section, the retirement board may elect to refund all <br /> <br />24 <br /> <br /> <br />
