Section 31--267. Service-connected disability retirement <br /> allowance. <br /> <br /> (a) Upon his retirement as provided in Section 31-266 on <br />or after July 1, 1977, a member shall ~eceive an ann~al retire- <br />ment allowance, payable at least monthly to him during his <br />lifetime and continued disabit±ty~ in an a~e~nt de%ermined <br />as follows: <br /> <br /> (1) With respect to any allowance falling due in a month <br />before the member's normal retire~.ent date, or in a month <br />before the member's normal retirement date and before any <br />social security allowance payment falling due that is based on <br />the member's primary social security benefit, or before <br />entitlement to total and permanent disability benefits under <br />the Social Security Act, ~wo-thirds (2/3) of the member's average <br />final compensation; provided that the benefit payable under <br />this paragraph shall not be less than the amount that would <br />have been pas~abte under the provisions of Section 31-265, as <br />determined at the time of disability retirement. <br /> <br /> (2) With respect to any allowance payment falling due <br />after the member's normal retirement date, or in a month <br />before the member's normal retirement date and after any <br />social secur%ty allowance payment falling due that is based <br />on the member's primary social security benefit or after <br />entitlement ko total and permanent disability benefits under <br />the Social S~curlty Act, an amount which when added to one-half <br />(1/2) of the initial annual ~mount of the primary social <br />security benefit at his normal retirement date, or to one-half <br />(1/2) of the initial amount of any social security payment <br />that is based on the member's primary social security <br />benefit and ~alling due before the member's normal retire- <br />ment, or to one-half (1/2) of the amount of the primary <br />total and pem~anent disability benefit under the Social <br />Security Act to which the member first became entitled, <br />would equal ~wo-thi~ds (2/3) of the member's average final <br />compensation~ provided that the benefit payable under this <br />Paragraph sh~td not be less than the amount that would have <br />been payable under the provisions of Section 31-265. <br /> <br /> (b) The foregoing provisions to thecontrary notwithstand- <br />ing, if a member's retirement allowance is payable under one <br />of the opti0n~ of Section 31-274 the amount and duration <br />thereof shatll be determined in accordance with the provisions <br />of the applicable option. <br /> <br />23 <br /> <br /> <br />
