(d) Anything to the contrary herein notwithstanding, <br />the men%bership of any person shall not cease by virtue of <br />the fact that he became eligible for membership in the <br />state supplemental retirement system upon transfer of the <br />department of public health of the City to the state health <br />department ~ffective July t, 1960. The membership of any <br />such person shall cease if his employment in the state health <br />depar~/nent thereafter terminates for any reason other than <br />death, retirement or resignation to accept immediate employ- <br />ment with the City in a position covered by the provisions <br />of this Article. Service with the state health department <br />by any such person shall be considered as creditable service <br />under this Article when determining eligibility for ordinary <br />disability retirement, service connected disability retirement, <br />and additional death benefits under Sections 31-270 and 31-271, <br />but such service shall not be considered as creditable service <br />when computing allowances under this Article. <br /> <br />Sections 31-231 31-235. Reserved. <br /> <br />DIVISION 4. <br /> <br />Statement to be Filed; <br />Creditable Service <br /> <br />Section 31-236. Filing of statement of facts as to status <br /> as member. <br /> <br /> Under such rules and regulations as are adopted by the <br />board, each member, or someone on his behalf, shall file with <br />the board, in such form as the board may prescribe, a state- <br />ment of the facts pertaining to his status as a member, which <br />shall include a detailed description of alt service rendered <br />as an employee, and such other information as the board <br />may require. Until such statement is filed, no member or his <br />.beneficiary sba1! be eligible to receive any benefits under <br /> this Article. <br /> <br />Section 31-237. Determination as to what constitutes a <br /> year of service. <br /> <br /> The board shall determine by appropriate rules and regula- <br />tions how much service in any year is the equivalent of a year <br />of service, but in no case shall it allow credit for more than <br />one year of service for all service rendered in any period <br />of twelve (12) consecutive months. <br /> <br />Section 31-238. Effective of cessation of membership. <br /> <br /> When membership ceases an employee shall thereafter lose <br />all right to any retirement allowance or benefits under ~his <br />Article arising from service prior to the date of cessation <br />of membership; except as hereinafter provided. <br /> <br />13 <br /> <br /> <br />
