AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 35-227 T~EREOF, PERTAINING <br />TO EXEMPTION OF REAL ESTATE TAXES FOR CERTAIN ELDERLY AND <br />PERMANENTLY DISABLED PEOPLE. <br /> <br /> BE IT ORDAINED by the Council of the City of Ports- <br />mouth, Virginia, that Section 35-227 of ~he Code of the City <br />of Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 35-227. Changes in status. <br /> <br /> It is the responsibility of any property owner to whom <br />an exemption has been granted to notify the director immediately <br />of any changes in respect to income, financial worth, ownership <br />of property or other factors occurring during the taxable year <br />for which the affidavit is filed and having the effect of exceed- <br />ing or violating the limitations and conditions provided in <br />this Article, which changes shall nullify any exemption of <br />real estate tax liability for the then current taxable year <br />and the taxable year immediately following. Provided, however, <br />when such chang~ in property ownership resulted solely from <br />the death of the qualifying individual, such change shall result <br />in a prorated exemption for the then current taxable year; which <br />prorated portion shall be determined by multiplying the amount <br />of the exemption by a fraction wherein the nu~er of complete <br />months of the year such property was properly eligible for such <br />exemption is the numerator and the number 12 is the denominator. <br /> <br /> Upon nullification or proration as provided herein, the <br />director shall so certify to the treasurer who shall proceed <br />to collect accordingly such taxes as may be due ~nd to adjust <br />his records accordingly. <br /> <br /> Adopted by the Council of the City of Portsmouth, Virginia <br />a~ a meeting held July 10, 1984. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
