AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTIONS 39-6 AND 39-7 THEREOF, <br />PERTAINING TO ABATEMENT OF WEED AND DEBRIS NUISANCE. <br /> <br /> BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that Sections 39-6 and 39-7 of the Code of the <br />City of Portsmouth, Virginia, 1973, be amended to read as <br />follows: <br /> <br />Section 39-6. Abatement by director upon failure of owner <br /> or occupant to comply with order, etc. <br /> <br /> If an owner or occupant fails, refuses, or neglects to <br />comply with the notice of the director referred to in this <br />Article, the director shall cause the nuisance to be abated <br />and shall transmit to the City Treasurer a statement of all <br />costs incurred thereby, included in said costs shall be a <br />seventy-five dollar ($75.00) fee to cover the administrative <br />expense incurred, all of which shall be added to the taxes <br />assessed against the real estate on which the nuisance <br />existed or abutting the alley, sidewalk or street 6n which <br />the nuisance existed, for the ensuing tax year and shall be <br />collected with such taxes by any manner prescribed by law <br />for the collection of City taxes. All costs incurred thereby <br />shall be docketed as a lien against the real property on which <br />the nuisance occurred or'which abuts the alley, sidewalk, or <br />street on which the nuisance existed, in the Nuisance Abatement <br />Lien Docket Book maintained in the office of the City Treasurer, <br />which lien shall exist in the office of the City Treasurer until <br />removed by payment of said costs in full. <br /> <br />Section 39-7. <br /> <br />Procedure for removal of weeds and debris <br />when owner is unkno~rn or cannot be found. <br /> <br /> If an owner of the land or lot on which the nuisance exists <br />or which abuts the alley, sidewalk, or street on which the <br />nuisance exists is unknown or cannot be found, the nuisance <br />referred to i~ ~39-5 shall be dispensed with, and the director <br />shall cause the offending weeds and debris to be cut, or if <br />necessary, removed and abated and shall transmit to the City <br />Treasurer a statement of all costs incurred thereby, which shall <br />include a fee of seventy-five dollars ($75.00) to cover the <br />administrative expenses incurred, which shall be added to the <br />taxes assessed against the real estate on which the nuisance <br />and/or offending weeds and debris existed, or which abuts the <br />alley, sidewalk', or street on which the nuisance and/or offending <br />weeds and/or debris existed, for the ensuing tax year, and shall <br />be collected with such taxes by any manner prescribed by law for <br />the collection of City taxes. All costs incurred thereby shall <br />De docketed in the Nuisance Abatement Lien Docket Book maintained <br />in the office of the City Treasurer, which lien shall exist until <br />removed by the payment of said costs in full. <br /> <br /> <br />
