That Sections'23-95 through ~3-98 of Chapter 23 <br />of the Code of the City of Portsmouth, Virginia, 1973,' as <br />amended, be repealed. <br /> <br /> 31 That Sections 23-21.1; 23-66.1, and- 23~482 be <br />added to Chapter 23 of the Code~of the City of Portsmouth, <br />Virginia; 1973, as amended, to read as follows: <br /> <br />Section~23-21.1. Issuance of warrant upon failure to <br /> comply with summons; penalties. <br /> <br /> (a) upon the failure of any person to comply With ~he <br />terms of a summons.or notice as provided in ~23-21, such <br />person shatl be guilty of a Clas~ 1 misdemeanor and ~he <br />court may direct the arresting officer or the clerk of the <br />court 'to obtain a warrant for his arrest or for the violation <br />of hfs written promise to appear given 'in accordance with <br />~23-21 and serve, or cause to be served, or'attempt., or ~ause <br />to be 'attempted, to serve such warrant on the person.' ' The <br />warrant shall be returnable tothe court having jurisdiction <br />of the offense and shall be accomPanied by a report by the <br />arresting officer which shall clearly identify the person <br />arrested, specifying the section of the Code of Virginia or <br />ordinance violated, the location of the offense, a description <br />of the motor vehicle and' its registration or license nu/mber. <br /> <br /> If the. warrant is returned to the court with.~the notation <br />"'not found" or the person named in the warrant does not appear <br />on th~ return date thereof, the court shall forward a certificate <br />of the 'f~ct of nonservice or nonappearance,, w~th a copy of <br />the report specified in (a) hereof, to.the Co~missioner of the <br />Division of Motor Vehicles. <br /> <br /> Section 23-66.1. Disregarding signal to stop by poli~e officers. <br /> <br /> Any personwho, having received a visible or audible <br />signal from any police officer to bring h~s motor, vehicle to <br />a stop, shall operate such motor vehicle in a wilful or. wanton <br />disregard of such signal.so as to interfere with or endanger <br />the operation of the police vehicle or endanqer other property <br />or person or who shall increase his speed and attempt to <br />escape or elude such police officer shall be guilty of a. <br />Class 2 misdemeanor, and, upon conviction thereof, Shall be <br />punished by a fine of not less than fifty dollars ($50~00) <br />nor more than one thousand dollars ($1,000.00) or by imprison- <br />-ment in jail for not less than sixty (60) days nor more than <br />one year or by both such fine and imprisonment.
