a period longer than three (3) consecutive days, and~the chief
<br />of police has given the owner of record of such motor ~ehicle,
<br />trailer or semitrailer at least'two (2) _days' notice in writing
<br />of the intention of the director of public safety to remove,
<br />or cause to be removed, such motor vehicle, trailer or semi-
<br />trailer, from such street or public ground to the city pound,
<br />or. has'made a diligent attempt to notify such owner, but has
<br />been unable to do so, and such motor vehicle, trailer or semi-
<br />trailer has not been removed, such motor vehicle, trailer or
<br />semitrailer shall be considered as abandoned,' and the chief
<br /> Of police is authorized and'empowered to remove, or cause~to
<br /> be removed, such motor vehicle, trailer or semitrailer to
<br /> the city pound, to be there held subject to the conditions
<br /> and provisions hereinbefore set for. th in this division.
<br />
<br /> Section 23-249. Vehicles abandoned in garages. '
<br />
<br /> Any motor vehicle, trailer, semitrailer or part theneof
<br /> left for more than ten (10) days ina garage operated for
<br /> commercial purposes, or for more than ten (10) days after
<br /> the period when, pursuant to contract, the vehicle was. to
<br /> remain on the premises, after notice, by registered or
<br /> certified mail, return receipt requested, within fifteen (15)
<br /> days thereof, to the owner of record and all persons having
<br /> security interests of record therein, to pick up .the vehicle,
<br /> shall be deemed an abandoned motor vehicle, and may be
<br /> reported by the garagekeeper to the City. All abandoned motor
<br /> vehicles left in garages may be taken into custody by the
<br /> City in accordance with S23-246 and shall be subject to the
<br /> notice and sale provisions contained in S~ 23-247 .and 23-248.
<br /> If, however, such vehicle is reclaimed in accordance with ~23-247,
<br /> the person reclaiming such vehicle shall, in addition to the
<br /> other charges required to be paid, pay the charges of the
<br /> garagekeeper. If such vehicle is sold pursuant to ~23-248,
<br /> the garagekeeper's charges, if any, shall be paid from, and
<br /> to the extent of, the excess of the proceeds of sale after
<br /> paying the expenses of the auction, the costs of towing,
<br /> preserving and storing such vehicle which resulted'from placihg
<br /> such vehicle in custody and all notice and publication costs
<br /> incurred pursuant to §23-247. Except as otherwise provided in
<br /> this Div.ision, nothing herein shall be construed to limit
<br /> or restrict any rights conferred upon any person dnder ~S 43-32
<br /> through 43-36 of bhe Code of Virginia, 1950, as amended~ For
<br /> the purposes of this section~ "garagekeeper" means any operator
<br /> of a commercial parking place, ~otor vehicle storage facility,
<br /> or establishment for ~he servicing, repair, maintenance 6r sale
<br /> of motor vehicles ~hether or not the vehicle had been ~rought
<br /> to such location with the consent of the owner or person, in
<br /> control'of the property..
