Section 23-233. 'Authorized. <br /> <br /> The chief of police or any police officer appointed by <br />him is hereby authorized and directed to remove or cause to <br />be removed, under any of the following circ%u~stances, any <br />motor vehicle, trailer or semitrailer from any street or <br />public ground £o the city pound ~o be designated by the city <br />manager and to be there held as hereinafter provided:. <br /> <br /> (a) When any motor vehicle, trailer or.semitrailer is <br />found on the streets or publi~ grounds of the city unattended <br />by the owner or operator and such vehicle, trailer or semi- <br />trailer constitutes a hazard to traffic, or <br /> <br /> (b) When any motor vehicle, ~railer, semitrailer or-.part <br />thereof is left unattended for more than ten' (10) days ~oon <br />any public property or any privately owned property other than <br />the property of the owner of such motor vehicle, trailer or <br />semitrailer or is abandoned upon such public property or' <br />privately owned property without 'the permission of the owner, <br />Ieasee or occupant thereof. <br /> <br /> For the purposes of this division, a motor vehicle, <br />trailer or semitrailer, or part therof, shall be presumed <br />to be abandoned if (1) it lacks fi) a current license plate or, <br />(ii) a current city sticker, or~ (iii) a val±d 'state inspection <br />certificate or sticker and ('2) it has been at a specific <br />location for four ('4) days without being moved. <br /> <br /> However, no such vehicle shall be removed from privatel~y <br />owned premises without the written request of the owner, <br />lessee or occupant thereof. Any person at whose request <br />such motor vehicle, trailer or semitrailer is removed from <br />privately owned property shall indemnify the city against any <br />loss or~'expense incurred by reason of removal, storage or <br />sale. <br /> <br /> (c) When any motor vehicle, trailer, or semitrailer <br />is stalled or rendered immobile as the result of adverse- <br />weather conditions or other emergency situations on any' <br />public roadway within the City. <br /> <br />Section'23-237.
