' i <br /> A violation of th~s sect on shall be punishable by a <br />fine not to exceed twenty-five dollars ($25.00). <br /> <br />Section 23-229. Parking in spaces reserved for handicapped <br /> persons. <br /> <br /> It shall be unlawful for a nonhandicapped operator of <br />a motor vehicle to park in a parking space reserved for the <br />handicapped at privately ownedshopping centers, business <br />offices, or parking lots or on the streets or public grounds <br />.of the city, unless such operator is using the motor vehicle ~ <br />to transport a handicapped person who has obtained a special- <br />vehicle parking permit from the division. For purposes'of <br />this section, the term "nonhandicapped operator" shall mean <br />the operator of a motor vehicle who has not been issued a <br />license plate, permit, or decal by the division designat.ing <br />such person as handicapped. The license issued by'the division <br />must be displayed in the front windshield of the motor <br />must be'displayed in the form of a permanent license plate <br />affixed to the vehicle. The decal or permit issued by'the <br />Division must be displayed in the front windshield of the motor <br />vehicle when such vehicle is parked in a parking spac~-~reserved <br />for the handicapped. <br /> <br /> A violation of this ordinance shall constitute a traffic <br /> infraction. <br /> <br />It shall be the duty of each police officer or other <br />~uniformed personnel employed by the'City to enforce parking <br />regulations to give to any person operating a motor vehicle <br />parked in violation of this section a notice, or to attach <br />to the vehicle found so parked a notice to the owner, that <br />such vehicle has been illegally parked in violation of this <br />section and instructing him to report ~o the Portsmouth Police <br />Department Headquarters. Each oerson so notified may within <br />seventy-two (72) hours from the-time when such notice'was <br />given or attached to the vehicle pay the sum of twenty~five <br />dollars ($25.00) due to his vehicle being illegally parked <br />in violation of this section. Upon failure of the violator <br />to pay the penalty for the violation noted herein.within <br />eight (8) days from the date of violation, a summons or warrant <br />for the prosecution of the violation shall be issued according <br />to law, without necessity of a warrant being obtained by the <br />owner of such private parking area. Any person convicted of <br />a violation of this section shall be punishable by a fine <br />not to exceed one hundred dollars ($100.00). <br /> <br />11 <br /> <br /> <br />
