or the clerk of court shall transmit %h~ l~censa to %he C~- <br />missioner atongwit~ the ~epo~t of the conviction required <br />to be Sent to the Divis.ion~ <br /> <br /> (g) When any person shall be convicted of reckless driving <br />as provided for. in paragraph fl0) of subsection (b) of this <br />section., then in addition to any ~ther penalties providedby <br />law, except in those cases for which 'revocatio~ of Ticenses is <br />provided in ~4S.1-4t7 of the Code of Virginia, the driver's <br />license of such person shall be suspended by the court or <br />judge for a period of not less than sixty f60) days nor mor~ <br />than six (6) months. In case of conviction, the court or <br />judge shall order the surrender of the license to the court <br />where it shall be disposed of in accorda'nce with ~23-87 of - <br />this Chapter. When the conviction is a second conviction <br />which would require revocation under the provisions of. ~ <br />~46.1-417 of the Code of V~rgin~a, the court shall suspend <br />the driver's license of such person and thereupon transmit <br />the same to-the division of motor vehicles as provided by <br />law. If such person so convicted has not obtained a Iicense <br />required by Chapter 5 of Title 46.1 of the Code of Virginia <br />or is a nonresident, such cour~ shall direct in the judgment <br />of conviction that such person shall not drive or operate <br />any motor vehicle in this state fora period of not less <br />than sixty (60) days nor more than six (6) months. <br /> <br /> (h) Notwithstanding the foregoing provisions, of this <br />section, upon the trial of any person charged with a violation <br />thereof where the degree of culpability is slight, the court <br />in its discretion may find the accused not guilty of reckless <br />driving but guilty of improper driving and impose a fine not <br />be exceed five hundred dollars ($500.00). <br /> <br />Section 23-88. <br /> <br />Driving while restoration of license is <br />contingent upon furnishing proof of financial <br />responsibility. <br /> <br /> (a) No person, resident o~ nonresident, whose ~'~i~§ <br />!icens~ ~6r ~instruction permit has been3 suspended or revoked <br />by any court or by the co~missioner o~ by operation of law <br />pursuant to the provisions-of this Chapter, Title 46.t of. <br />the Code of Virginia, ~18.2-271 of the. Code of ~irglnia ~or <br />any similar law or regulation or who has been forbidden aS <br />prescribed by law by the co~amissioner, the ~tate ~orporation <br />commission, the state h~ig~ay coIr~is'sione~ or the s~perintendent <br />of state police to operate' a motor vehicle in this state shall <br />drive any motor vehicle in this City during any period wherein' <br />the restoration of license or privilege 'is contingent upon. the <br />furnishing of proof of financial responsibility unless he has <br />~iven proof of financial~"responsibitity in the manner provided <br />in Article 6 of Chapter 6 of Title 46.1 of the Code of Virginia. <br /> <br />8 <br /> <br /> <br />
