AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA, 1973, BY AMENDING SECTION 32-35 PERTAINING TO <br />STREET CLOSURE APPLICATIONS. <br /> <br /> 1. BE IT ORDAINED by the Council of the City of <br />Portsmouth, Virginia that §32-35 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 32-35. Street closure applications; fee for <br /> processing same. <br /> <br /> A fee of one hundred dollars ($100) shall be paid to <br />the City for the processing of an application for the <br />vacation of any street or alley pursuant to ~15.1-364 of the <br />Code of Virginia. All closure proceedings shall be <br />commenced by filing an application for closure with the City <br />Planner. All applications shall be submitted on forms <br />prescribed by the City Planner. The City Planner shall not <br />receive any application unless such fee be paid at the time <br />the application is filed. <br /> <br /> On application the City Council may appoint not less <br />than three (3) nor more than five (5) viewers to view any <br />stueet or alley and report in writing whether in their <br />opinion, any, and if any, what, inconvenience would result <br />from discontinuing the same. Such viewers shall be paid a <br />fee of twenty five dollars ($25.00) each for their services <br />and same shall be paid by the person making the application <br />to alter or vacate the street or alley. <br /> <br /> 2.
