3. That Section 14-30 of the Code of the City of <br />Portsmouth, Virginia, 1973,~be amended and ordained to read as <br />follows: ..~._ <br /> <br />Section 14-30. Abatement by Director upon failure of owner <br /> or occupant to comply with Code. <br /> <br /> If an owner or occupant fails, refuses or neglects to <br />comply with any provision of this article after receiving <br />reasonable notice of said violation of this chapter, the <br />Director of Housing Services and Community Development shall <br />cause the nuisance or the condition which is in violation of <br />t~e article to be abated and shall transmit to the City <br />Treasurer a statement of all costs incurred thereby, included <br />in said cost shall be a Seventy-Five Dollar fee to cover the <br />administrative expense incurred, all of which shall be added <br />to the taxes assessed against the real estate on which the <br />nuisance or condition in violation of this Code or abutting <br />the alley, sidewalk or street on which the nuisance or <br />condition in violation of this Code existed, for the ensuing <br />tax year and shall be collected with such taxes by any manner <br />prescribed by law for the collection of City taxes. All costs <br />incurred thereby shall be docketed as a lien against the real <br />property on which the nuisance or condition in violation of <br />this Code existed, 'in the Nuisance Abatement Lien Docket Book <br />maintained in the Office of the City Treasurer, which lien <br />shall exist in the Office of the City Treasurer until removed <br />by payment of said costs in full. <br /> <br />Section 14-31. Penalties. <br /> <br /> Any person, firm, corporation or agent who violates or <br />fails to comply with the provisions of this chapter shall be <br />guilty of a misdemeanor. Each violation of a separate and <br />distinct provisio~ of this article shall be a separate offense <br />and each such offense shall be punishable by a fine of not <br />less than S20.00 nor more than $500.00. Each day any <br />violation of this chapter shall continue shall constitute a <br />separate offense. <br /> <br /> 3. That this ordinance shall take effect from the date <br />of its adoption. <br /> <br /> Adopted by the Council of the Portsmouth, Virginia, at a <br />meeting held October 14, 1986. <br /> <br />Teste; <br /> <br />City Clerk <br /> <br /> <br />
