AN ORDINANCE TO AMEND THE"CODE OF THE CITY OF PORTSMOUTH, <br />VIRGINIA,'~1973, BY AMENDING SECTION 33-18 PERTAINING TO <br />PLANNING COMMISSION' ACTION ON PRELIMINARY PLATS AND SECTION <br />33-22 PERTAINING TO RECORDATION OF FINAL SUBDIVISION PLAT--. <br /> <br /> BE IT ORDaiNED by the Council of the City of Portsm6uth, <br /> <br /> 1. That Section 33-18 of the Code of the City of <br />Portsm6~th, Virginia, 1973, be amended to read as follows: <br /> <br />Section 33-18. Planning Commission action O~3 <br />preliminary plats. <br /> <br /> The Planning Commission shal-1 give careful study to the <br />preliminary plat, taking into consideration the requirements <br />of the community and the best use of the land to be <br />subdivided, together with its prospective cSaracter, whether <br />residential, commercial, or industrial. Attention shall~ be <br />g~ven to street widths, arrangement, and circulation; surface <br />drainage and sanitation; lot sizes and arrangement and to such <br />neighborhood and community requirements as those of parks, <br />school and playground sites; and main thoroughfare widths and <br />locations. Prior to action, the property proposed for <br />subdivision shall be viewed in the field by the Planning <br />Commission or its authorized representative. The Planning <br />Commission shall complete action on such preliminary plat <br />within sixty days of its submission in accordance with Section <br />33-17. If the Planning Commission does not approve the <br />preliminary plat, it shall set forth in writing to the <br />subdividor the reasons for such denial and shall state what <br />corrections or modifications will permit approval by the <br />Planning Commission. <br /> <br /> If approval of a feature or features of the preliminary <br />plat by a state agency is necessary, the Planning Director ._ <br />shall forthwith upon receipt of the preliminary plat as <br />provided in Section 33-17 forward the preliminary plat to the <br />appropriate state agency or agencies for review. The Planning <br />Commission shall act on such preliminary plat within <br />forty-five days after receiving approval from all state <br />agencies. If the Planning Commission does not approve the <br />preliminary plat, it shall set forth in writing to the <br />subdividor the reasons for such denial and shall state what <br />corrections or modifications will permit approval by the <br />Planning Commission. Provided, however, if a State agency or <br />agencies are involved in the review process, the Planning <br />commission shall not be required to act on a preliminary <br />subdivision plat in less than-sixty days from the date of its <br />original submission as provided in Section 33-17 and that all <br /> <br /> <br />
