agent determine in writing and in his sole discretion that <br />only one offeror is fully qualified, or that one offeror is <br />clearly more highly qualified, than the others under <br />consideration, a contract may be negotiated and awarded to <br />that offeror. Offerors shall be accorded fai~ and equal <br />treatment with respect to any opportunity for ~iscussion <br />and ~evision of proposals and such revisions may be permitted <br />after submissions and prior to award for the purpose of <br />obtaining the best and final offers. Is conducting <br />discussions, there shall be no disclosure of the identity of <br />competing offerors or of any information derived from <br />proposals submitted by competing offerors. <br /> <br /> Awards shall be made to the responsible offeror whose <br />proposal is ~etermined in writing to be the most advantageous <br />to the City taking into consideration price and the <br />evaluation factors set forth in the request for proposals. <br />No other factors or criteria shall be used in the evaluation. <br />The contract file shall contain a statement in writing of the <br />basis on which the award was made. <br /> <br /> 2. That Section 11-129 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended by adding Subsection <br />(13) to read as follows: <br /> <br />Section 11-129. Exemptions from the required use of <br /> sealed bidding or competitive negotiation. <br /> <br /> (13) The School Board may authorize any of its schools <br />in the division to enter into contracts providing that caps <br />and gowns, photographs, class rings, yearbooks and g~aduation <br />announcements will be available for purchase or ~ental by <br />students, parents, faculty or other persons using nonpublic <br />money through the use of competitive negotiation as p~ovided <br />in this Article, competitive sealed bidding not necessarily <br />being required for such contracts. <br /> <br /> 3.
