AN ORDINANCE TO AMEND SECTION 11-127 OF THE CODE OF THE CITY <br />OF PORTSMOUTH, VIRGINIA, 1973, PERTAINING TO PROCUREMENT BY <br />COMPETITIVE NEGOTIATION; AND SECTION 11-129 PERTAINING TO <br />EXEMPTIONS FROM THE REQUIRED USE OF SEALED BIDDING OR <br />COMPETITIVE NEGOTIATION. <br /> <br /> BE IT ORDAINED by the Council of <br />Virginia: <br /> <br />the City of PortSmouth, <br /> <br /> 1. That Section 11-127 of the Code of the City of <br />Portsmouth, Virginia, 1973, be amended to read as follows: <br /> <br />Section 11-127. Competitive negotiation. <br /> <br /> Upon a determination made in advance by the purchasing <br />agent after reasonable notice to the public and set forth in <br />writing that competitive sealed bidding is either not <br />practicable or not fiscally advantageous to the public for a <br />specific procurement of goods, services, insurance or <br />construction, then that specific procurement may be made by <br />competitive negotiation. The writing shall document the <br />basis for this determination. <br /> <br /> Proposals shall be solicited from potential contractors <br />by request fo~ proposals which shall be in writing and shall <br />indicate in general terms that which is sought to be <br />procured, specifying th~ factors which will be used in <br />evaluating the proposal and containing o~ incorporating by <br />=eference the other applicable contractual terms and <br />conditions, including any unique capabilities or <br />qualifications which will be required of the contractor. <br /> <br /> At least ten (10) days prior to the date set for receipt <br />of proposals, public notice shall be given by posting the <br />~equest for proposals in a public arena normally used for <br />posting of public notices or by publication of the same in a <br />newspaper of general circulation in the a~ea or both. In <br />addition, proposals may be solicited directly from potential <br />contractors. <br /> <br /> Selection shall be made of two (2) or more offerors <br />deemed to be fully qualified and best suited among those <br />submitting proposals, on the basis of the factors involved in <br />the request for proposals, including price if so stated in <br />the request for proposal. Negotiations shall then be <br />conducted with each of the offerors so selected. Price shall <br />be considered, but need not be the sole determining factor. <br />After negotiations have been conducted with each offeror so <br />selected, the purchasing agent shall select the offeror <br />which, in his opinion, has made the best proposal, and shall <br />award the contract to that offeror.
